OP have you checked the entrance sign to that location? iirc it’s not even a CPM entrance sign at the time the PCN was issued. It’s an entrance sign from a complete different operator

Someone correct me if im wrong but dont operators who use anpr system must have that stated within their signage? I know CPM slip up a lot and dont mention anpr is in use on the actual terms and conditions signage but sometimes they mention it on the entrance sign. May be worth for OP to check if there is any mention of anpr being used on the signage.

PCM ntk aren’t pofa 2012 compliant due to 8(e)(ii). They didn’t mention “and pass the notice on to the driver”.

Will this win at appeal and ias? Of course not.

But in court it will.

I had 2 court cases against PCM in 2023 and won both on that point. The first case did take a little time but at the end of it the judge ruled in my favour due to this. The second case as i was walking in the judge said i already had a winning point but due to procedures we had to the hearing rituals and what not but that hearing only lasted 30 seconds max.

“This PCN was issued on the basis that the Appellant's VRN was not registered on the exemption list to permit him to park there. The Appellant appeals the PCN on the basis that the Operator is seeking keeper liability under PoFA but has not complied with the requirements of the Act insofar as they did not send the NTK within the correct timescales. The Appellant is correct in this regard; the date of the parking event is 19/5/2025 and the NTK was not issued until 3/6/2025; 15 days after the date of the parking event. The Act requires the NTK to be sent within a timescale that means it is received within 14 days of the date of the parking event (taking account deemed delivery dates). Therefore, I have no option but to allow the appeal.

I have considered all the issues raised by both parties in this Appeal and I am not satisfied that the Operator has established that the Parking Charge Notice was properly issued and therefore this Appeal is allowed.”


That was my result at ias. Just gotta spell out the timescales and date and the peanut heads will just about be able to understand it.

I appealed at ias with smart parking and they allowed my appeal. Ill post up the outcome in the next with hours.

Discussion about smartparking converting from BPA to IAS.

All my recent invoices from smartparking all had the BPA logo on the ntk yet today I wake up to emails from smartparking rejecting my appeal (even though it will 100% be cancelled as they still fail to adhere to pofa2012 after trying to “rebrand”) with no popla code. I look around the email and see the IPC logo aint smart parking stating i can appeal to IAS if i wish to do so.

Yet all their land signage and ntk still plastered with bpa. Interesting

Also may be hepful for OP during popla appeal, smart parking barely ever include landowner authorisation so make sure to point that out during your popla appeal. From the 100s I’ve gotten from smart parking over the years up to even last week, during popla they never prove landowner authorisation in their evidence pack.

That’s what I was thinking as well since the error was from the defendant itself. And whether it is accepted or not theyll still be out of pocket.

So im trying to help someone with their claim.

Long story short

They received a claim form dated 5th December 2024, acknowledged it 11th December 2024 (received auto acknowledgment), sent defence on same day BUT made an error with the claim number when sending defence via email. They’ve received a default judgement dated 13th January 2025 and when I asked them to look over what they’ve sent/received, turns out they’ve missed an email from the CNBC asking for the correct claim number as the one they’ve referenced was wrong by one character.

Claim form costs:
Amount claimed: £177.88
Court fee: £35
Legal representative’s court: £50
Total amount: £262.88
Daily interest rate of £0.02 until judgment.

Judgement form costs
£179.32 for debt
£110 for costs
Total: £289.32


Is it worth advicing them to complete the N244 set aside form for this mistake and pay the £303 fee? Also how likely do you think the court will accept the set aside?

Yes they are 99% likely to reject it based on the fact you appealled it outside the window and your most likely option will be small claim court to finish this once and for all.
