Hi All

The appeal has been rejected for the following reasons. Is there a standard reply that I can issue that shows POFA non compliance please?

The operator made their Prima Facie Case on 12/08/2026 08:49:08.

The operator reported that...
ANPR/CCTV was used.
The Notice to Keeper was sent on 30/07/2026.
A response was received from the Notice to Keeper.
The ticket was issued on 27/07/2026.
The Notice to Keeper (ANPR) was sent in accordance with PoFA.
The charge is based in Contract.

The operator made the following comments...
This parking charge was issued in line with PoFA 2012, as a result UKPS will continue to hold the registered keeper liable for this charge unless the appellant provides the details of the driver.

This private parking is for permit holders and customers of Food City only. Food City was not used and the vehicle does not hold a permit to park.

This parking charge has been issued in line with the sites terms and conditions.

I Have posted the following appeal at IAS.


I am the keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. UKPS has relied on contract law allegations of breach against the driver only.

I was NOT the driver of this vehicle at the time in question. Please check your photographs to confirm. Hint, I am a male aged 58.

This is the same username that I had on pepipoo.com and yes I used to own a Mitsubishi Pajero import. :)

I successfully used it many times between 2015 and 2018 when a certain person was at University. However, that was using the POPLA appeals service.
UPKS has directed me to www.theias.org for appeals.

The PCN says 'If you were the driver, UKPS Limited, the Creditor, request that this parking charge be paid using one of the payment methods...'

I was not the driver at the time this notice was served.

Hi

I have a PCN from UKPS for when I wasnt the driver.
Does the defence that 'I was not the driver at the time and I am not required to disclose the name of the driver' still work?
