I ANWER TO NEWHAM                               Thanks for the answer regarding IRR-2025-001304 SAR REQUEST CRM: 0640265. Are you claiming that I personally gave you the address E125AZ? Can you prove this? I don't even remember this address, and even at gunpoint I would never remember it! Could you send me an official denial for each of the 5 fines and explain in detail the reasons for the denial? I haven't received a single response from you to all my appeals. Can you send me a history of all the appeals, where I will see who responded to me and when? And most importantly, to what address? I would be grateful for any response from you!

You keep asking the same thing. I've already answered these questions 10 times. Even if you read what I sent to Morris and Newham, everything is perfectly clear. The bandits deliberately change addresses, and now they're already owed me £1,355. I've already proven this many times, and I have 4 of the same problems. Can you explain why I receive 1,000 letters and fines addressed to me, and my car is blocked and stolen at my address, while all the responses to my appeals are sent to an address unknown to anyone? Tell me it's an accident?

1. So Newham Information Rights Team have replied to your SAR but you never told us?  (Even though I've asked you twice in the last couple of days if you've had a reply...)

2. And you've written back to Newham without telling us that you had had a reply?

3. And Newham's reply to your SAR shows that they have been sending (some or all?) notices relating to your PCNs to the wrong address?

4. And is that wrong address the E12 5AZ address or some other address?

5. I've asked this before but you never answered - when you applied for a parking permit for the E13 8AY address but Newham issued a permit for the wrong address E12 5AZ, did you ever go back to Newham to try to find out WHY they had used the wrong address?

When @Enceladus suggested a couple of months ago that you write to the Tribunal to appeal your towing PCN, it sounded as if you never included your return address in the letter you originally sent, and that you only put your return address on the outside of the envelope.  Is it your usual practice not to include your return address in correspondence, but only to put it on the outside of the envelope?


What seems to be the key to your problem is that Newham are using the wrong address for you.

I am 100% certain that they are NOT doing so intentionally and that it is because they've got hold of the wrong address for some reason.

Trying to find out why they keep using the wrong address for you might help sort out your PCNs

I sent letters to Morris and Newham with the following content!                                                                                              InformationRightsTeam, thank you for your response on October 1, 2025, regarding case IRR-2025-001304. It shows that my address in responses to all my appeals was deliberately changed by Newham in order to deprive me of the opportunity to defend myself in court! The address is not mine, does not match the address of my car, is not the one to which I receive all fines and information about my car, and is not the address where my car is registered! This is not the address that I indicated in all my appeals and is not the one on my envelopes! I have had many incidents with Newham where they used address substitution, and I always lost time and money! Given this information, I ask that all cases regarding my fines be stopped.

Question about the permit = I've already explained 10 times that there are no signs near the house. A neighbor stole them 6 years ago and everyone parks there without a permit. I was fined on the next street, 30 meters from my parking lot, which is next to the house, and there are no signs there either. Although there are lines and signs 3 meters away. I've already written all this and shown pictures. The question about the letters is so stupid and pointless. Of course, I don't live alone, but how does this relate to my fines? If you have any questions, ask.

You seem unable or unwilling - for whatever reason(s) - to give straightforward and relevant answers to straightforward and simple questions.

You just keep repeating the same rants and asking the same questions over and over.  You have recently still been going on about there being no signs where you were parked even though it has been explained to you countless times over the last 12 months that signs were not needed where you were parked.  Also that you didn't have a parking permit.  You keep on accusing Newham of being Mafia gangsters trying to steal your car and money from you, and you've even accused other posters on here of being gangsters and being in a conspiracy with Newham to steal money from you.

This sort of over the top hyperbole might get results in Latvia or wherever, but it won't help you here.

If you want more help read the questions you've actually been asked and give relevant answers to them.  Nothing more and nothing less.

It's clear now that Newham is deliberately not responding to people's appeals to avoid escalating the matter. They're deliberately sending appeal responses to non-existent addresses! Please help!!! Where should I go in this case? How can I sue them? How can I stop the cases involving 5 illegal fines?

I haven't contacted Rundles. I received a response from Newham and pointed to #304, where it's clear that I haven't received a response to my appeal. The bandits send responses not to the car's address, not to my address, not to the address on the envelope, and not even to the address on the appeal letter. That's why I've been dealing with letters for five illegal fines for a whole year, and I don't have a single chance of taking the case to court! They also haven't sent me the codes for the court hearing. I have three such cases and want to resolve everything through the court. The Newham bandits also stole my second car, which I couldn't use due to the bandit's ULEZ .

Then I started looking into it, calling the gangsters' newham  agencies to ask them to provide information about why the 500 pounds were stolen from me, but they didn't give me anything. Then I managed to find information on a gangster website. There was only a photo of a car without a ticket on the windshield . That day I stopped there for 3 minutes and the black monkey didn't have time to put anything on the windshield. I saw this jerk, I walked past him, looked into his scary black eyes and he didn't say anything to me. I made sure the windshield was clean, got in the car and drove away. I asked these jerks why I hadn't received a single letter and why you stole 500 pounds, they gave my old address. I explained to the idiots that my car has been registered for 6 months and has a permit at the address  E12 5AZ . How interesting, they write letters to the old address, but block the car and steal 500 pounds from the car’s registration address?                                                                                                  And this time, only a year later, the bandits provided a response to my appeal, where it is clear that they send responses not to the car's address, not to my address, not to the address on the envelope, and not even to the address on the appeal itself. 1.  When you previously applied for a resident's parking permit and Newham issued a permit for the wrong address, was it for the E12 5AZ address, or for some other address?

2.  When did you apply for that permit?

3.  Did you ever try to find out why Newham used the wrong address, and did you ever try to get it corrected?  If you did what happened?

4.  Do you currently have a valid permit for your E13 8AY address?

5.  Are you the only person who has access to mail delivered to the E13 8AY address?

Please fill in the form once for each of the four PCNs, PN3987672A, PN39795559, PN39833603, PN39781678 to see can you get copies of the Notices of Rejection, is there are any. Fill in any further required details, such as your name and address, phone number etc.

Select the first option in the drop down box (Please select the nature of your enquiry) at the top, ie "I have submitted a PCN challenge or representation, but have not received a response".

Please take a screen print of the form submission page for each PCN.

Please don't go into any unnecessary details about the PCNs. The objective is simply to get sight of the Notices of Rejection for each PCN, if any exist.

In all my appeals I wrote something like this. But in all the responses I didn't receive a single answer, only the bandits’ desire to steal my money!!!                                                                                                             ...Hi, I hope you are doing well. I received this ticket for no good reason. The officer took a picture of my car but as you can see from the evidence I provided there is no parking sign in that area.
If the sign was clearly visible I would not have parked in that location.
Based on this evidence I am asking for my ticket to be cancelled. I have 5 tickets from the officer in that location 1453 PN39781678 PN39795559 PN39833603 PN3987672A PN39936195 . Please cancel all of these tickets based on my evidence! But if you think you and your officer are right then let's figure out how to resolve this in court. I have video evidence and plenty of witnesses! In court, I want to see this officer and everyone who decided that I violated something and should pay this fine! Good afternoon! I proved on the forum that Newham is a gangster, criminal organization. All these gangsters operate according to the same template. One method is sending letters to addresses where the person does not live, where their car is not registered, and there is no address where all the information about the car is sent! I have three such cases, and I can prove everything: fines without tickets, theft of money when registering parking, theft of money when registering parking at an address that was not ordered and documented, non-refund of money for the remaining parking when changing the address, and much more... Help me should I take my 5 illegal fines to court?

I assumed the Notice of Rejection was emailed to you? When exactly did you receive it?

And please confirm that you have not been resident at 12 Cumberland Road, E12 5AZ for six years?

They pretend to be idiots and respond not to the letter's address, not to the car's address, not to my address, but a deliberate fraudulent scheme, somewhere so that no one receives the letter! I check my email every day. I already wrote and showed a photo of the parking spot there are no no-parking signs. There are signs 3 meters away, and there are restrictions. I'm a normal person and I understand that where there is no sign, parking is permitted, but 3 meters away there is a sign that says no parking. This is very easy to prove in court. But these bandits don't respond to any letters or appeals. I also wrote that my attempt to buy a parking space is also impossible due to the complete fraud of this gang of newham ! Help!

You are being selective with the questions you answer and this is not helpful.
So once again, have you or have you not contacted Bailiff Advice Online for advice on how to negotiate a staged payment plan with Rundles?

And now, have you checked your email spam folder?

You don't seem to be facing up to the realities of your situation. You were repeatedly parked in a Permit Parking Area (PPA) apparently without a valid permit for the car. On at least five times that we know of, so eventually your car was towed to the impound yard. No signs are required within the zone, only at the entrance(s) to the PPA.

As things stand all five PCNs appear to be valid and also the tow-away. At this stage it's highly unlikely that you'll get any of the five PCNs overturned unless you can clearly show that the Council has made some sort of fundamental error.

Do you now have a permit for the car?

It's a good idea to go to Councillor Morris's surgery. But please don't get angry with him about your situation. It's his job to help you get answers from the Council, so keep him on your side.

He cannot try to influence the outcome of your PCNs, however he can help you to get a proper response to your subject access request.

Once a proper response is provided we might be able to show that the Notice of Rejection for the tow was never properly served. And if you did submit formal representations against the other four PCNs then the evidence will be there. At the moment you haven't shown us any such evidence and the PCNs have escalated to bailiff enforcement.

Good afternoon! Can anyone really help? I haven't received a single response to my two appeals for the theft of my car? I haven't received the codes for a decision through the tribunal? The Newham gangsters aren't responding, and I've already accumulated a lot of fraud cases against them! Morris isn't responding either? They're asking me to pay the gangsters, but for what??? I haven't broken anything? Only the Newham gangsters and their accomplices have violated the law, and they should be in prison!

Try sending the email suggested below to InformationRightsTeam@newham.gov.uk and copy john.morris@newham.gov.uk
At the bottom I have put your phone number as 07nnn-nnnnnn. Please correct that to your actual phone number.
And please stick to the issue of the SAR. Please don't add any complaints about signs and so on.

Put "Complaint - Subject Access Request IRR 2025-001304" in the email's subject line".

Post up the acknowledgement emails when you get them.

Getting your information about the PCNs from the Council is one issue. Rundles are a parallel matter. So I still strongly advise you to contact Bailiff Advice Online (https://bailiffadviceonline.co.uk/) for advice on negotiating a payment plan with Rundles. Phone them.

Re: Subject Access Request IRR 2025-001304

On July 23rd 2025 this SAR was submitted to the council via the online portal provided for this purpose and an acknowledgement email was received, also on the 23rd July.

To date I have not received the council's substantive response nor any explanation for its lateness.

On August 25th I wrote again via email to InformationRightsTeam@newham.gov.uk pointing out that the response to the SAR was now overdue. Again I received an acknowledgement. This acknowledgement advised that a response to my SAR would be sent by the 12 September 2025.

Once again I have not received any response nor any reason for the failure to comply with your own deadline.
 
I would be grateful if you would look into this as a matter of priority. Please let me have a full response to my SAR within seven calendar days via post and email. Else I will be compelled to consider escalating your failures to the Information Commissioners Office.

and

Did you get back in touch with Bailiff Advice Online to see what help they might be able to give to you about negotiating a payment plan with Rundles? Rundles is a legitimate firm of Enforcement Agents employed by Newham. Enforcement agents are also known as Bailiffs.

If you don't get Rundles under control then sooner or later your car will be clamped, impounded and then auctioned off to pay the charges and additional sale fees.

Re the Tribunal replying to the wrong address.  In reply #149 Maks said:

If only it were that simple.

The two good letters sent to the Tribunal were sent by post, recorded delivery. @maks posted up photos of the letters and they had the E13 8AY address. As I recall the first garbled letter might not have had any correspondence address on the letter except for the return address on the envelope.

The posted copy of the Tribunals first refusal to schedule an appeal never arrived. However the letter was subsequently received attached to an email. @maks scrubbed the address on the emailed copy before posting it up. Later we were shown the address, an address in E12 5AZ.

The E13 8AY address was also on the V5c and all of the documents received at the impound yard. It's also on 4 sets of NTOs, Charge Certs, OfR and bailiff Notices of Enforcement, all of which @maks received. And also on two non-statutory follow up letters from Rundles.

So I'm confident that @maks has been using the correct address. And the only way I can explain the E12 5AZ address on the Tribunals letter is that the Council gave it to the Tribunal and they used it despite the address on @maks letter.

Despite several requests Newham have not provided the original Notice of Rejection and nor have they provided it in response to his SAR request and follow ups.

In addition this whole unfortunate tangled mess appears to have occurred because @maks did not have a valid parking permit for the car. In one of his posts told us that he had a lot of difficulty with his permit application. Including that at one point a permit was issued but with an incorrect address and presumably for the wrong parking zone.

This is why we submitted an SAR to get sight of all the documents related to all 5 PCNs.

Please read my posts #258 and #260 above. I wrote out an template email for you. I asked you to send the email to "InformationRightsTeam@newham.gov.uk and copied to john.morris@newham.gov.uk".

And I also asked you to post up anything that came back.

I don't see any acknowledgement receipt emails from the InformationRightsTeam or from Councillor Morris that dated after Sept 12. Only the older receipts from July and August. So have you sent the email or not? If you haven't sent it then please get that done urgently

I also pointed out that getting all the documentation from the Council via the SAR and that dealing with Rundles are parallel matters. You cannot ignore Rundles. They can and likely will impound your car and will auction it off.

I assume you want to keep your car so I advised you to approach Bailiff Advice Online for advice on negotiating a staged payment plan with Rundles.

In October it will be a year since I responded to all the fines and filed appeals twice. I asked to stop all the fines and resolve everything through the tribunal. But I didn't receive a single response to the appeals, the fines weren't stopped, they didn't send the codes to open a case in the tribunal. Newham doesn't respond to my letters, I wrote a letter to John Morris, the head of our district, he didn't respond either, I wrote to bailiffadviceonline.co.uk  and they replied that they couldn't help.

OP, let's try and address the immediate problem.

Contact bailiffadviceonline as per previous advice as soon as possible. At this stage, why you didn't follow advice previously is, IMO, not the issue, you have to deal with the bailiffs.

Thanks. I had doublechecked but I didn't even see the link way over on the right of the post.

So the OP has again misunderstood the advice - in this case to approach bailiffadviceonline - and has asked her about the SAR to Newham rather than asking about how to approach the tickets he hasn't paid?   [Edit:  Actually I see the advice given twice was very clear - to contact bailiffadvice for suggestions about how to agree a payment plan with Rundles, not to discuss the SAR!]

I did suggest way back on 27 March that as English clearly wasn't the OP's first language (although somebody claimed it was!) and as he obviously didn't have a clue as to how the process worked, he might benefit from a link explaining the process.

(I'd have done it myself but I don't think I'm any more expert than the OP in this)

They've already charged the £235 "attendance" fee, it's included in their ref:22713225. They can only charge the £235 once regardless of how many PCNs they are trying to collect.

If they seize your car then they can charge an additional £110.

I strongly advise you to contact bailiff advice online (https://bailiffadviceonline.co.uk/). Ask for help with negotiating a staged payment plan with Rundles.

At the bottom I have put your phone number as 07nnn-nnnnnn. Please correct that to your actual phone number.
And please stick to the issue of the SAR. Please don't add any complaints about signs and so on.

Put "Complaint - Subject Access Request IRR 2025-001304" in the email's subject line".

Post up the acknowledgement emails when you get them.

Getting your information about the PCNs from the Council is one issue. Rundles are a parallel matter. So I still strongly advise you to contact Bailiff Advice Online (https://bailiffadviceonline.co.uk/) for advice on negotiating a payment plan with Rundles. Phone them.

Re: Subject Access Request IRR 2025-001304

On July 23rd 2025 this SAR was submitted to the council via the online portal provided for this purpose and an acknowledgement email was received, also on the 23rd July.

To date I have not received the council's substantive response nor any explanation for its lateness.

On August 25th I wrote again via email to InformationRightsTeam@newham.gov.uk pointing out that the response to the SAR was now overdue. Again I received an acknowledgement. This acknowledgement advised that a response to my SAR would be sent by the 12 September 2025.

Once again I have not received any response nor any reason for the failure to comply with your own deadline.
 
I would be grateful if you would look into this as a matter of priority. Please let me have a full response to my SAR within seven calendar days via post and email. Else I will be compelled to consider escalating your failures to the Information Commissioners Office.

As to Councillor John Morris, I believe he has been on holiday but has now returned. So I still expect he will respond to you. Councillor Morris' job as an elected Councillor is to represent you, as a person resident in his ward, with your problems with the Council. He can't intervene directly with parking PCNs but he can intervene with Subject Access Requests.

And I repeat my earlier question:
Do you share your front door letter box with anybody else?

Right now your best bet is to negotiate a staged payment plan with Rundles. But let's see the letter first.
If you don't get Rundles under control then your car will be clamped, then quickly impounded and sold at auction to pay the debts.

As things stand you have no recourse to any court any more.

The surprising thing to me is that it has taken Rundles so long to step up the enforcement process.

And are you using Google Translate or some program like that. I get the impression that you are not understanding what the forum members are telling you. Maybe that's due to translation errors or limitations. I assume your native language is Latvian then please try and find somebody who can translate our posts on here for you.

Read reply #239 again. It's not been switched off for you, it's no longer available for anyone. There's a reason we advise people against uploading directly onto here. The simple reason for limited upload space is money - image hosting requires storage, storage is expensive, and this site is free.

Arguing the toss about image hosting won't get the bailiffs off your back, providing the information that some of our (remarkably patient) experts need, using a suitable alternative like Imgur, might.

Anyone who is aware of my topic knows that I have not received a single response to 50 appeals, including Newnam and his boss John Morris .I have been writing appeals for 1 year and no one has responded, I immediately knew that no one would respond on September 12. Well the calendar month to respond to your SAR has expired. So I would have expected that you should have received a response by now, even if it was just to inform you that there would be a delay or to ask for further information.

Have you checked your email spam folder?

When you filled in the on-line Subject Access Request form on the 23rd July, did you upload proof of ID and proof of address? For example, a copy of your driving licence and a bank statement or similar?

Do the documents you provided have your correct and current address? And is that the E13 8AY address? And please confirm that you actually live there?

Quite frankly it's very difficult to understand what is going on here.
You submitted representations against the vehicle impound but no response was received.
You submitted a follow up request and no response was received.
You wrote twice (and a third garbled letter) to the London Tribunals and they sent their responses to an address that is six years out of date, even though that is not the correspondence address you provided.
The Tribunal could only have received that address from the Council.
Now you've submitted a Subject Access Request, received an acknowledgement but no response has been received, either by post or email?

On the other hand you have received every statutory document concerning the four other PCNs including the bailiffs Notices of Enforcement, all correctly addressed. Yet there has been no visit from the bailiff to attempt collection of the money claimed. This is also unusual in Newham.

Might there be something else going on that you haven't disclosed?

Anyway you will now have to complain to the Council about the failure to respond to the Subject Access Request.

I also suggest that you write to your local ward Councillors and seek help from them. Whilst the Councillors can't influence the outcome of a PCN, they can help you follow up with your complaint about Newham's failures to respond to your correspondence. I believe you live in the ward of Plaistow West and Canning Town East so try john.morris@newham.gov.uk who is the Deputy Cabinet Member for Highways and Sustainable Transport.

I'll try and write something up for you on Monday.

You applied on the 23rd July. Whilst I am disappointed that they have not yet responded, their acknowledgement email states that the time limit to respond to a Subject Access Request is 30 calendar days. The law says one calendar month.

On a generous interpretation that means that you might not see the response until Friday the 22nd August.

I have several letters and then by phone! I have already sued these ****, they blocked my car and asked for 200 ... but when I tried to pay online the amount increased to 300. I had to call the **** and agree on 200. I paid 200 but the **** sent letters that if I paid 100 to some **** and 100 to others, then I still owe them!!! The **** offered me a lawsuit by phone, but I replied we will meet in court! The court did not even mention the 100 for the ****, and I won the lawsuit! Now they do not let me go to court!!! Because my car was parked in a parking lot without a single sign!

I suggest you apply online or by email as that won't be subject to postal delay. The email address is InformationRightsTeam@newham.gov.uk .

Below is the letter I suggest you send to the Council for the SAR. Try and preserve the formatting so that the letter remains legible. And please don't include any photos of where you were parked or comment on the lack of signs. At the moment all we want is the missing correspondence, so we can try and improve your justification to overturn the refusal by the Tribunal to register an appeal.

I'm trying to keep it as simple as possible. However has anybody got any amendments to suggest?

In the case of the four PCNs, PN3987672A, PN39795559, PN39833603, PN39781678, it seems that you did not challenge the PCNs with the Council in the form required and within the time limit. Since there were no proper challenges the are no Notices of Rejection and there are no rights to appeal to the Independent Adjudicator, regardless of a verification code or not.

These four PCNs have now escalated to a total due to the bailiff of £1355. (1 x £515 + 3 x £280). And there is a threat to levy a further £235 which I do not believe they can lawfully do.

In the case of PCN PN39936195 there should be a code on the Notice of Rejection which they claim to have sent to you on the 28th Oct 2024. However you have been rejected by the tribunal, rightly or wrongly, on the grounds that your application to register an appeal is too late.

Concerning the four PCNs PN3987672A, PN39795559, PN39833603, PN39781678.

You received a Notice to Owner for each one. So far as I can determine, you failed to submit a formal representation against any of them within the time-frame allowed. If you had done so, then the PCNs would have been cancelled or a Notice of Rejection would have been issued. Without a Notice of Rejection (challenge) the Tribunal will not schedule an appeal.

If it is the case that you did submit formal representations then please post them up. These were either letters you sent or online submissions that are dated after the dates on the Notices to Owner.

You've left yourself in the situation that you cannot submit Witness Statements in response to the Orders for Recovery that you received since you have no legitimate grounds to do so.

Your only hope is to find some reason that might persuade the Council to accept late formal representations and this is a very long shot. The only issue I can find is that, for an unknown reason, some of your correspondence might have gone to a very old address at postcode "E12 5AZ". And that might be the address that resulted in your application for a resident's parking permit being refused. That's why I've asked for copies of anything you have with the "E12 5AZ" address. It was the lack of a permit that caused the PCNs in the first place.

Your answers can very confusing and too vague. Is there any other address involved, other than E13 8AY and E12 5AZ?

Your attempt to register an appeal, PCN PN 39936195 and tow, with the Adjudicator at the London Tribunals has been rejected twice. The last time by a senior and experienced Adjudicator. It seems that you did not explain the situation clearly enough, however you also confused your requests by adding in the other four PCNs. I hope you haven't aroused suspicion that you are trying to play the system. You will have to try again.

ok I received a letter from the collectors yesterday, there are some codes there. Maybe through them I can open a case through the tribunal?

Mow we have a further complication. The bailiff letter mentions failing to collect £515. The bailiff visit fee of £235 is included in that. They are only allowed to charge it once, so to threaten a further £235 is out of order.

£130 = Notice to Owner
£65 = Charge Certificate Surcharge
£10 = Traffic Enforcement Centre registration fee
£75 = Bailiff compliance stage fee
£280 = sub-total Notice of Enforcement
+
£235 = Bailiff visit fee
£515 = Total

And the bailiff should be trying to collect all four PCNs, and the one £235 fee should cover all four.

Risky as it might sound, I think you could get another PCN and let us guide you through from start to finish.

In my opinion, you are VERY unlikely to resolve all of your issues through the tribunal because they are not obligated to consider anything but the PCN concerned in a Notice of Rejection. In my opinion you would have to obtain a clear statement from the adjudicator regarding the common theme of the signage and then return to the council and using different channels use any decision to convince them to look again at the whole raft of PCNs.

Can anyone help? I have uploaded the letters here, but there are no codes to resolve the issue. This means that I was not offered to resolve the issue through the court. If I am wrong, correct me. Why does NewHam send me letters to E138AY, and the tribunal and NewHaM indicate some fictitious addresses that are in no way connected with the addresses of the fines, the address of my car, the addresses on the envelopes, the addresses in my letters and my personal address? 6 years ago I lived there. But today I have changed 4 houses and paid for parking at other addresses. Newham has already used this criminal scheme and made me pay 500 pounds. They claimed that they sent letters, but to my old address. But my car was already registered at the new one and parking was paid for. In the end, when I found information about the fine on the photo of my car, there was no ticket. I saw that officer that day, but he did not have time to stick anything on my car and did not tell me anything. And 6 months later these criminals blocked my car and asked for 500 pounds! I think they always do this and I am not the first. So I need to open a case in court where I can prove all the criminal actions of Newham.

The letter from the Tribunal is addressed to you at an address with postcode "E12 5AZ". Which is not the address on your V5c registration document, the impound yard receipt, your representation against the tow, or any of the documents associated with the other PCNs. And it is not the address you put on the last two letters to the Tribunal all of which have the postcode "E13 8AY" address.

I don't know why the Tribunal want to write to you at the "E12 5AZ" address? It can only have come from the Council when they confirmed that they had issued a Notice of Rejection. It seems to be a possibility that the Notice of Rejection was posted to the E12 5AZ address as well.

Do you have any association with the E12 5AZ address? Or did you have in the past? Did you ever live there, work there or is it maybe the address used by the person who sold you the car? Anything?

Is the E12 5AZ address the incorrect address used by the Council for the parking permit application?

You'll need to have another attempt at the Tribunal. The latest rejection seems unreasonable.

And a Subject Access Request to the Council.

I was fined on the next street from my house, there are no prohibiting signs! Before that, I parked near the house, there are no signs there either, and no one fined me. The neighbors said that one of the neighbors himself removed these signs in order to have free parking and repair other people's cars there without paying for parking and not paying taxes. I've reviewed the whole topic several times and I am struggling to find anything useful that might persuade the Council to consider late representations.

However it seems to me that the area where you're parking is very close to where you live and within the same parking zone, Plaistow North.

The root cause of your woes with penalty charge notices and the tow away of your car appears to be that you don't have a resident's parking permit for the Plaistow North (PN) zone. Or didn't at the relevant times.

Do you have anything in writing or emails from Newham indicating that the council won't issue a permit? Please post up everything you have. Do you now have a parking permit?

You can have multiple cars and multiple permits at one address provided that it's not a car-free housing development. However the permit for the first car will be the cheapest. Subsequent permits for  additional cars will be more expensive. The cost of the permits also varies according to the CO2 emissions with a further surcharge for diesel vehicles. So a permit for a third or fourth car at the same address might be very expensive.

If you are sharing your house with others and they also have cars, then I would hope that the landlord has put something in the tenancy agreement as to how the total parking permit bill is to be divided up between you. If there isn't anything in the tenancy agreement then you should agree something between you.

Below you've mentioned a one month permit being issued but not for your current address? Please explain, what "completely different" address was the permit issued to? When did you move out of that address? Or did you never live there?

How can you punish these animals for deliberately ignoring answers? How can I start legal proceedings for the remaining 4 fines? After all, they deliberately do not send me the code so as not to give me the opportunity to resolve the problem through the tribunal! I think that they always act like this! I have a lot of problems with Newham! I have not been able to buy a permit for a whole year, they claimed that one car was already registered there and there were no more options! I called them and they offered to buy it for a day for 5 pounds! Now they are offering but double the rate, I don’t know why? Knowing these freaks, I tried to buy it for 1 month, indicated the address, sent confirmation of the address, and received a document on payment. But when I began to study this document, the address I indicated was not indicated there. There was no address at all, only some letters. I studied these letters and it turned out that they took the money for a completely different address, not the one I paid for, and not the one I proved in the documents, on the same day I rejected the order and asked for a refund. The animals replied that they do not return payment for 1 month! Then I asked every day to return the money, because they took the money for a different address, not the one I indicated. And a month later they returned it but stole 5 pounds!!!

Your letter shows as delivered last Monday the 30th June. So it's a bit too soon to expect a reply. Give it another week. Perhaps phone the Tribunal and ask?

The PCN and tow were your best chance to get at least one PCN before the Adjudicator. I doubt very much that the High Court would consider any judicial review hearing, at considerable expense, unless you have first appealed to the Adjudicator and exhausted the process.

You are not helping yourself by conflating the PCN for the vehicle removal with the other four PCNs.

As to the other four PCNs. They are beyond the stage where the signs or the lack thereof are relevant.

You cannot appeal to the Adjudicator as you have not made Formal Representations to the Council and been rejected. The Adjudicator will not schedule an appeal until there is a Notice of Rejection, one for each PCN/Notice to Owner.

You haven't provided any evidence to us that you did submit Formal Representations against any of the four Notices to Owner. The four Notices to Owner are the second stage of the enforcement process.

Your only hope with the four PCNs is to submit formal representations to the Council with a plea to accept them well and truly late so you can appeal to the Adjudicator. The Council are under no longer under any obligation to do anything, but I suppose it's worth a shot. And it's a very long shot.

I'll see if I can draft something for you to send on Monday, I haven't time to do it right now. I really must be a glutton for punishment.

I sent 3 letters to the tribunal, the last one on 06/26/2025, but I haven't received a single response, only one by email. What other options are there to raise the case in the tribunal? Are there any active lawyers here? Maybe I should call the newham and ask them to stop everything until the tribunal's decision and ask them for codes to open a case through the tribunal? I need to record this conversation for evidence in the tribunal! Perhaps I can call the tribunal directly, since I've already used all possible options but haven't received an answer? I have several letters and then by phone! I have already sued these ****, they blocked my car and asked for 200 ... but when I tried to pay online the amount increased to 300. I had to call the **** and agree on 200. I paid 200 but the **** sent letters that if I paid 100 to some **** and 100 to others, then I still owe them!!! The **** offered me a lawsuit by phone, but I replied we will meet in court! The court did not even mention the 100 for the ****, and I won the lawsuit! Now they do not let me go to court!!! OP, the Tribunal rejected your application. Put simply, they said that the NOR was issued on 28 Oct. and that your application to the Tribunal was dated 25 May 2025, therefore out of time. This has nothing to do with addresses as such.

It doesn't seem as if they considered that, unlike a 'normal' NOR where ultimately you can access the Tribunal via the Order for Recovery/Witness Statement route, with removals this opportunity does not exist.

I would write back and ask again.

I refer to my letter dated *** in which I requested that I be allowed to appeal to an adjudicator against the enforcement authority’s decision to reject my representations in respect the the removal of my vehicle and your letter dated *** refusing my request. So your V5c seems to have the correct name and current address. In which case why would the London Tribunals try to write to you at the old address? I would expect them to respond to the address you put on your Notice of Appeal letter.

The impound receipt also has your correct and current name and address

The Tribunal must have got the old address from Newham. Did you ever give the Council and/or the Tribunal this other old address?

Have you got a Newham parking permit? Perhaps that has an out of date address associated with it?

OP, I'm trying to simplify this, pl correct if I am wrong. I have not referred to the other PCNs in detail or your repeated attempts to get a response from the council, I have tried to keep things to the bare essentials.

You have received several PCNs for parking at the same location which you believe is not correctly signed.

One of these resulted in your vehicle being removed.

You retrieved your car on 17 Oct. and submitted formal reps to the authority which were delivered on 23rd. October. You have a Royal Mail tracking record in support.

The authority have not responded, you therefore do not have a code which would give you access to the adjudicator.

You have written to the adjudicator setting out the above and asking that your case be listed as an appeal notwithstanding the authority's failure to provide this code.

You have had a response from the adjudicator 'I wrote to them that I wrote an appeal but did not receive a response, they claim that I was late.' but we haven't seen this. Pl post.

Please confirm what you mean by "but in the response they wrote me a completely different address"?

Does "they" refer to the Tribunal? I assume so.

Is the address the Tribunal used something different from the address you provided on your letter? I assume so.

In that case was the address used by the Tribunal ever an address associated with you? In particular have you ever used this incorrect address with Newham Council.

Please check the V5c registration document for the car. Is the name and address of the Registered Keeper 100% correct and current? I assume it is as you have received the statutory notices for the other 4 PCNs.

As I see it the person who retrieved the car from the impound yard and paid the charges is entitled to make representations and submit an appeal to the Adjudicator at the Tribunal. That's you, even if the Registered Keeper details are out of date.

We seem to have an impasse. The Tribunal won't schedule an appeal because you have no Notice of Rejection. And the Council refuse to respond to or ignored your request for the Notice of Rejection. (Somebody please confirm if I am correct or not about who can appeal?)

Perhaps the Council are responding to your requests, but the letters are going to this incorrect address?

You'll need to write back to the Tribunal and quickly. But let's get the facts clarified first.

It seems that you did not include your home address on the letter. And a correct and current address is a mandatory item.

You've removed all the paragraph separations and the spaces between sentences. Thus making the letter very difficult to read.

You've removed the letter title "Notice of Appeal". So the purpose of the letter is no longer self evident.

Hopefully the Tribunal will email you and tell you revise the letter and resubmit. On the other hand it's quite possible that you'll hear nothing.

If you don't hear anything by the end of May then you'll have to write to the Tribunal again, this time correctly formatted.

The intent is to persuade the Tribunal to schedule an appeal in respect of PCN PN39936195 and the towaway without the required appeal form and the verification code. You might have a chance of winning that PCN and getting your money refunded. But you've no chance if you don't get a grip on the situation.

Please try the letter below to get PCN PN39936195 and the towaway appealed to the Adjudicator.

You'll have to tailor it to suit. IE put in your name and address and so on. You will also need to include copies of the postal receipts from the 21/10/2024 and 13/03/2025 and also printouts of the Royal Mail tracking from the 23/10/2024 and the 17/03/2025.
Don't send originals, only copies.

Include an email address if you wish.

Please triple check all the details for yourself, IE PCN number, dates, tracking numbers and so on. Don't rely on me having them correct.

This letter only concerns PN39936195 so please don't include anything to do with any of the other four PCNs.

Post the letter at the Post Office counter and ask for a proof of posting. It might take two or three weeks to get a response from the London Tribunals, but when you do please post back immediately.

I write to ask you to register and schedule an appeal in respect of the above Penalty Charge Notice and the subsequent impounding of my vehicle, also on the 16/10/2024.

On the 17/10/2024 I paid £265 in charges to recover my car and received a "Representations" form.

I completed the form and posted it on the 21/10/2024 to the address provided for the purpose, L B Newham Parking Correspondence, PO Box 71575, London, E6 9LY, using a Royal Mail tracked service. Please see attached copy of the proof of posting.

The Royal Mail tracking service show that my letter was delivered on the 23/10/2024. Tracking number 02121B12016B5A71 applies, please see attached delivery report.

To date I have not received any response. In particular I have not received any Notice of Rejection or appeal details or the validation code required to submit an appeal to the Tribunal.

On the 13/03/2025 I again wrote to the Council at L B Newham Parking Correspondence, PO Box 71575, London, E6 9LY, using a Royal Mail tracked service. The letter was delivered on the 17/03/2025, Tracking number KL458909921GB applies, please see the attached proof of posting and the attached delivery report.

My letter asked the Council to cancel and refund the charges because the Council had failed to respond to my Representations against the PCN and removal within the 56 day day relevant period specified in the regulations. My Representations are therefore deemed accepted. I also asked the Council, if they did not agree, to provide the necessary validation code and forms to appeal the matter to the Tribunal.

To date I have had no response to my letter.

I have been deprived of my lawful right to appeal this matter to the Independent Adjudicator at the London Tribunals.

I would be grateful if you would please register and schedule an appeal in person.

PN39936195  when I picked up my car I asked for an appeal form. I immediately sent them an appeal via tracking, you can see that they received it! I did not receive a response. On your advice I sent another letter, they received a letter .there were no answers!
If any response does arrive then please post it up on here.

You will now need to write to the London Tribunals and ask them to manually schedule an appeal on the grounds that Newham have not responded to your formal representation and follow-up. You have a chance of winning because they failed to respond to your original formal representation within 56 days, as discussed earlier.

You've posted up a Notice to Owner, a Charge Certificate, an Order for Recovery and a TE9 Witness Statement that has not been completed all in respect of PCN PN3987672A. These are all documents that you've already posted.

In addition, yesterday you posted up a bailiff's Notice of Enforcement for PCN PN3987672A.

You have not posted up anything that you sent to the Council concerning PN3987672A. Or any response that they made to anything you sent if you did send anything.

All of the documents are the standard escalation notices that automatically follow on from non-payment or a challenge to a Notice to Owner.

The Order for Recovery is a Court Order. You still didn't pay so the matter is now in the hands of a bailiff.

The same scenario seems to apply to all four PCNs.

Please stop entangling PCN PN39936195, which is for the PCN & towaway) with the other four. And please answer the question.

You wrote to the Council on the 13th of March 2025 concerning PN39936195. Have you or have you not had any form of response to that letter? If so, then please post up what you received?

Concerning PCNs PN3987672A, PN39795559, PN39833603 & PN39781678 which have now escalated to bailiff enforcement. You said above "....I also wrote appeals for all 4. They ignored everything and only asked for money...."

For each PCN, when did you do that? And what did you write?
Based on what you have so far told us it seems that you wrote something to the Council when you found the PCNs on your car. They wrote back and rejected you. The rejections would have advised you to wait for the Notice to Owner and then submit 'Formal Representations' however you haven't shown us anything that shows that you did that.

Because you did not submit any formal representations against each of the NTOs the matter escalated and further notices were sent, but it seems you still did nothing. Is that correct or not?

Because it seems that no formal representations were submitted, the Council did not issue any Notices of Rejection (or Acceptance). The Adjudicator will not consider a hearing unless you have first submitted a formal representation and have been refused. The rejection would have included the online credential you need to submit an appeal.

Basically in respect of each PCN when exactly did you write to the Council. And how and when? Email or postal letter on dd/mm/yyyy?

As per previous advice.

PCNs PN3987672A, PN39795559, PN39833603 & PN39781678 have now escalated to bailiff enforcement. They are demanding £280 for each which is correct. That's a total of £1120.

If you don't pay then they, the bailiff, will visit your address and attempt to seize goods that they can sell. This will likely be the car, if they can find it. For this visit they will charge an additional £235 and another possible £110 if they actually auction your car.

However what has happened with PCN PN39936195 dated 16/10/2024? This concerns the PCN and tow of your car. You filled in the challenge form received from the impound yard and posted it. The Royal Mail tracker shows that it was delivered on the 23rd Oct 2024. You've told us you received no response.

I advised you to write to the Council about this, you did so on the 13th March 2025. The Royal Mail tracker says the letter was delivered on the 17th March 2025. I would have expected some sort of response by now. Have you received anything?

If you have received a response then please post it up. If you have not received anything then you will have to write another letter to the London Tribunals and ask them to manually schedule an appeal.

You have also told us that you appealed to the Council about the above four PCNS with Notices of Enforcement, however these were 'informal representations' with respect to the on-street PCNs attached to your car. The Council did respond to these representations and declined to cancel the PCNS. You did not pay.

You do not appear to have responded with 'formal representations' to the subsequent Notice(s) to Owner for each of the above PCNs by writing to the Council. Nor did you respond to the subsequent Charge Certificates and you then ignored the subsequent Orders for Recovery. The Orders for Recovery are Court Orders instructing you to pay the Charge Certificates.

As such you have no right to appeal to the Independent Adjudicator at the London Tribunals. Nor have you any right to apply to the court to have the process reset as you have ignored, or otherwise failed to action, the notices you were sent.

The Independent Adjudicator will not hear your cases because you did not follow the procedure which was to respond to the Notices to Owner. Had you done so, then the Council would have had to issue the credentials required to submit appeals.

If the above is not correct then please tell us when and what you sent to the Council when you received the Notices to Owner?

You have a £1120 / £1355 problem and potentially an impounded car. The only long shot that I can come up with is to submit late representations against the four PCNs to the effect that you misunderstood the enforcement process and ask them to settle each PCN at the discount rate of £65 and to call off the bailiff. They are not obliged to consider such a representation. But they might.

Yes, I wrote appeals. I sent them a photo where you can see that there are no signs. I told them that I will only resolve this issue in the tribunal!. I described everything at the beginning of this topic. I need their refusal and the case number to transfer the case to the tribunal! But they haven’t responded for 6 months!

You cannot solve the matter via the tribunal, because the process has passed beyond that to bailiff enforcement. You can only get to the tribunal if you can get the PCN debts that are registered at the Traffic Enforcment Centre cancelled and the process reverted to the PCN stage.

The only way to revert the process is for you to submit an Out-of-Time Witness Statement, one for each PCN. However, it would seem that you never responded to the PCNs so the process just ground on like it always does.

Did you submit any representations to the council at all ?

I think @maks might find it very helpful if one of the forum members (all of whom are more knowledgeable than me) posted one of those useful links that actually explains the procedure step by step from receiving a PCN to the end.  I'd do it myself if I knew what I was doing regarding PCNs but I don't know what I'm doing.

The OP's first language obviously isn't English and he clearly hasn't a clue as to how all this works.  (He reminds me of Captain Haddock ranting in a TinTin cartoon soemtimes)

How can you punish these animals for deliberately ignoring answers? How can I start legal proceedings for the remaining 4 fines? After all, they deliberately do not send me the code so as not to give me the opportunity to resolve the problem through the tribunal! I think that they always act like this! I have a lot of problems with Newham! I have not been able to buy a permit for a whole year, they claimed that one car was already registered there and there were no more options! I called them and they offered to buy it for a day for 5 pounds! Now they are offering but double the rate, I don’t know why? Knowing these freaks, I tried to buy it for 1 month, indicated the address, sent confirmation of the address, and received a document on payment. But when I began to study this document, the address I indicated was not indicated there. There was no address at all, only some letters. I studied these letters and it turned out that they took the money for a completely different address, not the one I paid for, and not the one I proved in the documents, on the same day I rejected the order and asked for a refund. The animals replied that they do not return payment for 1 month! Then I asked every day to return the money, because they took the money for a different address, not the one I indicated. And a month later they returned it but stole 5 pounds!!!

We can now see that the OP posted his representation to the Council's PO box 71575, postcode E6 9LY on the 21st Oct 2024. This is evidenced by the posting receipt. And that the letter was delivered on the 23rd October 2024 according to the Royal Mail tracking

So I suggest that the OP now sends the letter I posted earlier, unless anybody wants to revise or improve it.

The objective being to get an appeal form and verification code from the Council so that an appeal can be registered with the London Tribunals for PCN PN39936195 and the tow-away.

Once again, when does the the tracking say your letter was delivered? Print off a copy of the tracking from the Royal Mail website. And post up the tracking on here.

You cannot appeal to the Independent Adjudicator until you get hold an appeal form. This might at least get the £265 PCN and tow before the Adjudicator.

I suggest you write a letter something like the below and post it to Newham. You'll have to fill in the blanks. See what comes back. Post your letter 1st class at the post office counter and obtain a free of charge "proof of posting". See what comes back.

Wait for others to comment or amend or improve my letter.

I think it may help maks if they stopped expecting someone to walk up, smite the claimants down and leave maks untouched without maks engaging with the process. The people here are brilliant, some of the best in the business, and they are helping people for free. But it's help based on being given all the information available, not bits and pieces. The alternative is a bill over £1,000 which will happen if maks lets it.

Where are your representations against the PCN which resulted in the tow?
How were these sent?

maks, we keep trying to help you but we are not getting clear answers to our questions.

Below I've summarised my interpretation of all the posts so far.  Please can you confirm if it is correct or not.

Between 25 September and 16 October 2024 you have received 5 PCNs on your vehicle in this car park.  On the occasion of the fifth PCN (16 October 2024) your vehicle was towed and you paid £265 to get it released.

You submitted formal representations against the tow PCN, and informal representations against the other four PCNs.

Since then you have received a Notice of Rejection in respect of the tow PCN, and rejections to your information representations against the other four PCNs.  The other four PCNs have since progressed through the Notice to Owner stage and the Charge Certificate stage and you now have Orders for Recovery for them all.

Assuming that is all correct:
- If you have it, please show us the contents of your representations sent to Newham against the tow PCN (did you send one which covered all the PCNs together)?
- How and when did you submit these representations (email? letter? webform on Newham website? other?)
- Please show us the Notice of Rejection you received to the tow PCN in its entirety (including "standard wording")
- Did the Notice of Rejection include details of how to appeal to the independent tribunal, and did you initiate such an appeal?

By not engaging with the other four PCNs beyond the informal representations stage (if this is true), you have likely missed the opportunity to challenge these altogether.  Your best hope lies in getting the tow PCN somehow resurrected, which we can only assist with if you provide the information requested.

Can anyone help? How to stop the actions and solve this only in the Trebunal? My car was parked in a place where there are poles but no signs! 4 meters opposite there is a sign and the stripes of the sign!

You don't have two PCNs sitting at £205 each. You have four according to the documentation you have shown us.

If you don't get a grip on this the Council will get bailiff warrants authorised by the Traffic Enforcement Centre at Northampton Count County Court. The bailiff will write to you at a cost of £75 per PCN. £205 + £75 = £280. £280 x 4 = £1120. That £1120 on top of the £265 you've already paid out for PCN PN39936195.

I've repeatedly asked you for the date your letter of representation, against PCN PN39936195, reached the Council as per the Royal Mail tracking you say you have. But we're still in the dark.

It should be possible to get this case before the independent Adjudicator. But you need to cooperate.

You cannot submit an appeal to the Independent Adjudicator at the London Tribunals online as you have no Notice of Rejection of your formal representation against PCN39936195. Hence I asked you previously to contact the Council and ask them for a manual appeal form and to also contact The London Tribunals and ask them if they can provide a form to submit a manual appeal. Have you done either of those tasks?

The only PCN I'm interested in is the one which resulted in a tow.

You say you made reps, but when and how?

You might get to the council via the back door i.e. that if you were to get to tribunal and win regarding the tow then you would be able to go back to the council via non-parking channels and get the others cancelled irrespective of where they are in the process because they are based upon the same facts.

If you keep going on about 4 PCNs to the exclusion of the tow and your reps then I can't see any hope for you as regards these channels.

As many others have told you, the courts are not involved in this process. There is no magic document that will change this well established process that everyone has to go through.

We are trying to help you, and it seems you may have a good point, but you need to follow the proper legal process, and we can't help you do that without seeing exactly where you are in the process. If all you do is keep shouting about courts, the inevitable end of the process is Bailiffs arriving at your house and taking away goods to cover ever increasing fines.

Please help us to help you, by posting the documents we need to see.

OP, I posted on page 1:

As matters stand, you don't have a defence against PCN along the lines you've been arguing: the parking place doesn't have markings...because these aren't allowed in a PPA where the parking restriction applies to the permit holders specified in the gateway signs. PLEASE forget about the 4 PCNs.

And I say it again.

Finally - page 4- you actually posted a letter from the council.

As far as I can see you are correct in that the contravention did not occur, but not because of your reasoning i.e. no sign = unenforceable restriction.

Go back to the definition of a PPA:

....where any parking place within that area reserved for the use of the permit holders as indicated on that sign is not shown by markings on the road (whether or not an upright sign is placed next to, or near, such a parking place to indicate that only the permit holders in question may use the place)

I have highlighted the relevant part.

The last GSV shows that this parking place was NOT reserved to PN permit holders, it was shared use.

IMO, shared use falls outside the definition of a PPA and any such parking place within such an area must be marked* and signed.

Wait for the views of others.

*- markings don't have to be lines, they may be contra-coloured surface treatment or similar, just so that the area is differentiated from the main carriageway.

Did you, or did you not, submit representations against the four Notice to Owners ? If you did, please post-up one of their replies rejecting your representation. We cannot possibly help you if you don't help us
Once again, can I emphasise that there is NO COURT !  What there is, is an adjudication office, in London called  London Tribunals. This is not a court, but comes under the Justice ministry, and deals with all parking and traffic PCNs in London if the recipients of those PCNs register an appeal to them.

Appeals can only  be registered once the council has previously rejected representations against a Notice to Owner.
Sorry but the bottom line is if you don't follow the process, you'll lose; it's that simple.

in this country there are 10 different signs for parking 2 meters for each car, for 20 minutes, for 30 minutes, disable, payment by phone and others... 4 meters from the car there is a sign and the outline of the parking space! the sign that is 200 meters behind a 90 degree turn does not prohibit parking with 2 posts and without signs! this is done on purpose, I have seen 1000 similar options! perhaps such signs only work in closed spaces and not on a simple driveway! that is why I want only through the court! if the court is corrupt, then I will file 1000 appeals! I ask again how to go to court? Who can give real help? Where should I go, who should I write to, what should I do so that only the court will consider this case and stop it now?

Unfortunately you appear to have misunderstood the parking restrictions.

The spaces are covered by the local parking zone which has signs as you turn into the street - any bay not signed is subject to these rules ( in your case it needs a PN permit). The bay across the road is signed because it has different regulations - it allows pay parking. This is pretty much as the council has responded - and any further appeals (e.g. To the tribunal) would likely have come to the same conclusion.

I proved that all the fines were illegal, I sent a photo where you can see that the car is parked near 2 poles on which there is not a single sign! But animals work there who fine their own mother for the sake of 65 pounds for beer! I uploaded a photo of the trucking and evidence that they received it on 23.10. 2024. I ask again, who can help? I responded to all their statements. I asked to stop all cases until the court decides, I asked to send me a form for a decision through the court, I send them evidence that the parking lot is without signs. I responded to them and wrote appeals. In response, they only asked for money! NTO = Notice to Owner. You've posted up four of them. £130 each.

PN3987672A 20/11/24 = date of notice
PN39795559 26/11/24 = date of notice
PN39833603 27/11/24 = date of notice
PN39781678 27/11/24 = date of notice

You should have either paid them before the deadline or you should have submitted a formal representation against each of them before the deadlines. Instructions to that effect are included on the NtOs.

So far as I can make out you didn't submit representations or make payment of the NtOs. So each NTO escalated to the Charge Certificate stage, you have four of those. And when the CCs weren't paid they in-turn escalated to the Order for Recovery (of unpaid penalty charge) stage, where you also have all four notices.

Is the above incorrect? Did you write to the Council about each of the above NTOs, if so please post up what you sent or filled in on line? And the dates you submitted?

Concerning the paid PCN for the vehicle removal. You've told us you filed in a formal representation against the tow and sent it registered post. And you have had no reply. But when does the tracking say the letter was delivered?

Uh-oh. The rejection letter posted relates to PN3987672A. It is a rejection of your informal representation against the PCN.

The letter explains that if you don't pay a Notice to Owner will be issued.

It seems you didn't pay and so a Notice to Owner for the full penalty of £130 was issued. This was sent to the Registered Keeper of the vehicle as held by the DVLA. In this case you are the RK. You didn't pay the NTO or submit a formal representation challenging it.

The matter then escalated, as previously described, to where you are now. Please confirm that you have the same letter for the other three PCNs?

Please confirm that you did not write again to the Council when you received the Notices to Owner? For all four PCNs.

I assume you didn't and it was a mistake not to submit formal representation (challenge) against the NTOs as the matter escalated to where you are now. Since you did not challenge you did not receive any Notices of Rejection of your formal representations and without NoRs you cannot appeal to the Independent Adjudicator.

You also cannot get the processes reset via a Witness Statement because you did not submit formal representations against the NTOs.

So you have received the Orders for Recovery. An Order for Recovery is what it says on the tin. It's a type of court order telling you to pay £205 per PCN. If you don't pay by the date stated then Newham will apply for bailiff warrants who will attempt to impound your car or to seize other property. So you cannot ignore the orders.

Whether or not you can lawfully submit the Witness Statement forms depends on what exactly has happened within the enforcement process. So for each of the four PCNs, when you first received the PCN on your car what did you do? Did you write to the Council and challenge the PCN? That's called an informal representation. Did you get a written reply?

Next you received the Notices to Owner? Did you write to the Council challenging the NTOs, known as a formal representation? Did you receive any written replies?

I answered them every time that I will not pay anything, because there is no proof that my car is parked under a prohibition sign. I always asked to send me a form to resolve this through the court. I sent an appeal for the theft of my car, after 2 days the appeal was delivered! But I did not receive a single answer! They sent only fines of 65, 130, 195 and now they sent 205. I think that they do not answer questions because they know that they 100% lose the court!!!

As I understand your situation.

PCN PN39936195 16/10/24 you paid £65 penalty charge + £200 release fee to recover the car.
You then posted a representation to the Council and the Royal Mail tracking shows that it was delivered.

To date no response to your representation/challenge has been received.
Without an NoR which would normally include the required verification code you cannot submit an appeal online to the London Tribunals.

When did you you post the challenge to Newham and what date was it delivered?

You will need to contact Newham and ask them to send you the necessary appeal form and complete it manually and then submit that to the tribunal with an explanation as to why you have no code and are possibly late. You can also phone the tribunal and check if you have to get the form from Newham, maybe they will send you one. Confirm the postal address or ask if a scanned copy via email is acceptable?

London Tribunals
Tel: 020 7520 7200 (Monday to Friday 9.00am to 5.00pm and Saturday, 8.00am to 2pm, excluding bank holidays)

If you do nothing then the matter will escalate further to warrants for a bailiff which will add a further £75 for each PCN. Plus a fee of £235 if the bailiff has to visit to collect. They will likely try and find your car and clamp it, if necessary impound it. That's £1075 £1355 on top of the £265 already paid if you don't get a grip on this PDQ.

You submit a formal representation to the Council against the Notice to Owner or the PCN for the vehicle removal. If the Council reject then they have to post a Notice of Rejection with instructions on how to appeal to the Adjudicator and a verification code. That's the code the LT are looking forward.

You cannot appeal without that a Notice of Rejection has been issued. And you won't receive the NoRs unless you have submitted a formal representation against an NTO, or exceptionally a representation against a removal PCN. The latter because you have to pay the PCN to release the vehicle and normally paying a PCN closes the case.

So where do you stand with each of your PCNs? Please post up a list.

Except as I said, there is NO COURT and NO TRIALS !  What there is, is London Tribunals, where you can appeal the PCN to an adjudicator. If you win, you pay nothing, if you lose you must pay the PCN penalty.

You can only register an appeal at LT once you have had representations to the council rejected.  So if you don't submit representations to the council, you cannot register an appeal at LT.

So, for each PCN, please tell us whether you submitted representations or just paid, and whether you have registered an appeal at London Tribunals or not.

The bottom line is that if you don't follow the process, which is under civil, not criminal law, you will have bailiffs at your door seeking to seize property, and it's usually your car they sei=ze.

The first time I paid, took the car and filed an appeal. But I haven't received any answers for 3 months! The other 4 fines were 65, then 130, then 195 and the last ones asked for 65 pounds so as not to take it to court. Now they will try to steal the car again to intimidate me! I don't want to talk to them, only in court! Help me start a trial!

This is the last time they stole my car. I spent 2 days looking for my car and went to pick it up for 265 pounds!

You've posted none of the documents we need to see. Until you do we are totally in the dark. YOu last posted on December 6th last year

There is no "court", but if representations to the council are rejected you can appeal to the London Tribunals.

SO, please help us to help you or you'll eventually have bailiffs at your door.

Unless you can give us some account with dates of what has happened in the intervening period we cannot even attempt to help. Try answering Enceladus' questions in post Reply#3 above. Or

For a start you could post here
copies ofthe front of each PCN,
copies ofthe remaining pages of one PCN.
copies of what you have written to the council,
copies of every subsequent document received from the council.

I am not sure you understand the enforcement process. Please have a read of

@maks, take a deep breath, and stop panicking. You are in good (others, not mine) hands here. These people are the best experts in handling situations just such as yours, but they need all the information you can provide. The councils attach tickets and hope to scare people into paying by various tricks and threats. The most important items are all the PCNs ('parking tickets') that have been put on your car. They will look at these, and can help you construct a defence. The experts will analyse your tickets, assess them against the regulations and the Law and even write you a response and sometimes represent you in proceeding, depending what is needed. They will take you through the process step by step. All you need to do right now is to take a picture of both sides of every bit of paper you have been sent or had put on your car, upload them (to imgur.com preferably), post the links here and let the magicians get to work.

Help me how to solve this problem through the court? Where to call, who to contact? From the very beginning I wrote appeals, proved that my car was not parked under the prohibition signs. There are poles for signs, but there are no signs themselves. I proved that in their pictures my car is not under the sign. In my appeals I asked to send me a form to resolve this issue in court or to explain to me how to resolve the issue through the court. But I did not receive a single answer! They asked for 65 for each of the 5 fines, then 130, then 190, and the last one again 65. As far as I understand, they are afraid of losing in court! How to go to court, help!

Looking on the latest streetview picture, the pole is there but no parking sign attached, the sign is shown attached to it on earlier streetview pictures.

Opposite the parking lot there is another parking lot where there are lines and a prohibiting sign. So I don’t understand how they can fine me?

@NeilB, some details are in the 'Formal Response' attachment to the OP's post at 12.11 yesterday, although its presence is rather drowned out by the shouting capitals!

It's a code 12, but the date and time aren't in evidence so the OP still needs to post these. The o/s amount is £130, but exactly where the OP is with the PCN which relates to the council's evidence, who knows?
I had looked but I only saw pics.
'12' makes more sense.

Just a reminder that this PPA only applies at certain times and only Mon-Sat, yet there is a marked and signed bay opposite where the OP parked, that allows permit holders OR pay-by-phone.

For me this is a confusing situation.

It's a Permit Parking Area.

'permit parking area”
 an area—
(a)
into which each entrance for vehicular traffic has been indicated by the sign provided for at item 5 of the sign table in Part 3 of Schedule 5; and

(b)
where any parking place within that area reserved for the use of the permit holders as indicated on that sign is not shown by markings on the road (whether or not an upright sign is placed next to, or near, such a parking place to indicate that only the permit holders in question may use the place)

If you look at GSV 2022, you will see that the road has parking places galore with matching markings and signs, including where you were parked. Now there's not a parking place sign in sight(which is optional for the council) or markings(it's mandatory that these are removed)....because these have been replaced by the Permit Parking Area gateway signs, one of which is in your photos.

As matters stand, you don't have a defence against PCN along the lines you've been arguing: the parking place doesn't have markings...because these aren't allowed in a PPA where the parking restriction applies to the permit holders specified in the gateway signs.

No, and there doesn't need to be either, because it is within a Permit Parking Zone. Obviously you missed these signs when you drove along the street and then parked : -

These zones are the invention of the Devil, but entirely legal. Within them, only permit holders can park within the restricted times, and no signs or lines are needed. However, while most of them are 24x7, here, outside the restricted times, there are still bays for permit holders only, so if you'd parked outside the restricted hours you would have been OK.

You could argue that there is confusion because close by where you parked is a permit holder, or pay-by-phone bay, so the absence of a sign where you parked caused you to assume no parking restrictions applied. This zone has been very badly set-up, and you should submit reps on that basis. Don't be upset if they reject them, because councils reject ALL informal reps, and most formal ones. You will only get a fair hearing at London Tribunals, but must risk the full PCN penalty if you go there.

Worth submitting an informal challenge, as they may ****-up their reply

The PCN & tow must be a London Borough? £200 tow charge + £65 for the PCN?
From your description you submitted a representation (challenge) for this and have had no response. When did you send the representation recorded delivery? The Council should have responded within 56 days.

Please post up the above PCN and any other documents you received at the car pound. Just redact (obscure) your name and address where present and any payment card number from the receipt. Leave everything else visible including the vehicle registration and the PCN number as well as any dates and locations.

By court I believe you mean the Independent Adjudicator at the London Tribunals? You cannot normally submit an appeal to the Adjudicator until you have a Notice of Rejection from the Council.

From your opening post it sounds like the remaining three PCNs have escalated. So please post up a list of the PCNs with the date of issue and the dates of any further documents you might have received. Such as Notices to Owner, Charge Certificates, Orders for Recovery or Notices of Enforcement.

Good day! Tell me how to stop the fines and open a decision through the court? I have 4 fines for parking where there is not a single sign. I know many cases when after an appeal everything is resolved. They even took my car, I lost 2 days to find a car and had to pay 265 pounds. I took an appeal form from them, filled it out and sent it by recorder letter.Tracking the letter showed that they received it, but I did not receive any response! In the appeals I wrote that my car was not parked under the signs. I asked to suspend all decisions and give me a form to discuss these fines in court.But I didn't receive any answers!  But they still send letters and ask for money.I have a question: how can I resolve this issue through the court?
