yellow PCN notice code62 from BRENT COUNCIL

so I got the yellow envelope PCN from brent council, basically just a quick stop at yellow double line (no more than few mins to unload something quickly at the house, which is where my parents live). So it is basically new double lines they have added in front of their driveway (which wasn;t there at all, so I was not paying attention.

I have received notice to keeper, this happened in february so I made challenge and the council reset the discount pay time (which I think means there is a good chance maybe I can appeal this successfully but not sure how exactly? any advise will be very appreciated

(Dear sir/madam, I would like to challenge the PCN BT24279827. I am the registered keeper but not the driver at the time. The driver has advised that it was stopped for just briefly to unload something quickly to the property beside the yellow line. We have been visiting family member in the address for more nearly 10 years and the yellow line was never there. There was no sign or notice to road users so it was very confusing. The yellow double line was only in place very recently and also the PCN has not stated exact location. The driver is no longer in the country unfortunately. But we have knowledged the new change in the neighborhood now and therefore will be very alerted next time. We will appreciate if you can kindly cancel the PCN or advise how this should be taken to further action. Many thanks again. best,

. The PCN had not been addressed to the driver on scene, which was not myself on the day. It didn't has the accurate location which made it invalid. The note stated that the civil enforcement officer B1366 observed and believed that a penalty charge is payable. I will appreciate if you can kindly cancel the PCN. If not please kindly advise the POPLA appeal / complain procesure. many thanks again for your kind assistance.

The PCN is for footway parking and nothing to do with the yellow lines. POPLA is also irrelevant.

What's this about the location?

I can't see any established footway parking in Carlyon Road.

hi it is just here,,, we used to park here all the time before the yellow lines were introduced. never had any issues, but it was just quick offload and left.

Do i have any ground to appeal at all or just pay up maybe? I have also updated my V5C with a slightly different name, shall I just leave this as it is in my old name or the CCJ (if there is to be in the future) will follow / result in my new name?...

I feel so painful having to pay so many PCNs every year, most private ones can be cancelled but council PCN just seems impossible for any of them to be cancelled..

The letters were all addressed to my old name not my current new name, will it still be in ccj or other record that comes back to me still?

I also have bailiff letters but on council websites it allows me to pay less amount can I do that and the bailif will stop? kindly advise...

Cannot be correct. PCN issued 3 Feb. therefore the earliest dates for the next stages would be:

Notice to Owner: served 2 March;
Latest date for representations: 29 March;
Charge Certificate served: 30 March;
Order for Recovery: 14 April;
Latest date to pay: 4 May.
Bailiff.....after 4 May.

Can we pl, pl just have a clear timeline and what you have received.

and for Bailiff / warrant it is for this one.

Sorry, but if I wasn't confused before, I am now ! The rule is one PCN per thread, (or several for the same contravention at the same location).

So what advice to you want ?

Anyway, for the bailiffs, the only avenue open to you to get the matter reverted to the PCN stage is to submit an Out-of-Time Statutory Declaration, using Forms PE2 and PE3, which can be downloaded from the Traffic Enforcement Centre website. Advice is to pay the bailiffs to freeze liability, as acceptance of an OOT SD means bailiff fees become refundable, (but not the PCN penalty).

For the double-yellow line contravention, you say you have had representations against the Notice to Owner rejected. Please post up what you have received.  If they have re-offered the discount, this may be your best option. If they haven't then you can appeal to the adjudicators at London Tribunals, the penalty remains the same.

And finally, there is no possibility whatsoever of getting a CCJ, the legal process has been created to avoid this possibility. Hopefully I can put your mind at rest on that one at least.

*- your slight change of name is not the issue provided your DVLA registered keeper address is correct. A NTO would be delivered there and if you think you are the person to whom it's addressed then you may open it and action it. But come here first.

hi sir thanks for your kind assistance, my sincere apologize...I have been so overwelmoned with numerous PCNs and bailiffs etc, it just drives me crazy. I did try to post just one PCN per time, so sorry for confusion again.

So for this driveway / yellow double line from Brent council (PCN BT24279827 ), they have rejected my informal challenge and offered discount rate..So like the other person have suggested I might just have to pay this at discounted rate now?

The PCN reads location OPP HOUSE NO 24 on Carlyon road ( it is outside number 7), I was just dropping something to my parents and left it was always ok to park there but the council has added a pole outside on the pathway where there are officers frequently checking now..

Council PCNs seems exteremly difficult to be cancelled I know... maybe I should just pay up as well to avoid further action.

Pl keep this thread for the footway parking PCN otherwise confusion will likely reign. Tou already have a thread for the 'bailiff' PCN.

The discount is formally on offer until 9 May and the authority should not issue a NTO until this has lapsed.

At present, I cannot see any winning defence against the contravention itself, but we see many appeals to the adjudicator won on procedural points which are equally as valid - kmown as 'procedural improprieties' or PIs for short.

As it stands, the registered keeper would risk the discount if they continued to challenge the PCN, but we often see authorities re-offer the discount even after unsuccessful formal reps. Pl don't ask what the likelihood is of a PI in your case - if I knew the future I'd do tonight's lottery and review the rest of this thread from a beach in the Bahamas.
