Newham council PCN

Received this contravention a few days ago. It was quite confusing with all the roadworks in progress so my son must have gone through a 'No entry' sign which may have been temporary.
Is there anything that can be done. Thanks in advance.

This is a new restriction.

Two "no entry" signs on Ordnance Road have appeared at the junction with Malmesbury Road. The back of one of them is visible on the lamppost on the right side of the video. The sign on the other side is not in the camera view because of the scaffolding and hoarding but it's unobstructed from the other side, where the BMW came from.

This means you can no longer exit Ordnance Rd onto Barking Rd. There are new blue ahead only arrows on the two corners of Ordnance Rd as you enter it from Barking Rd. So the stretch of Ordnance Rd between Barking Rd and Malmesbury Rd is now one way only. One way the opposite way to the direction the BMW was travelling.

It seems that traffic on Ordnance Rd now has to turn right onto Malmesbury Rd and then left onto Oak Crescent in order to exit onto Barking Rd.

There are two no entry signs at the junction of Barking Rd and Oak Crescent. And surprise, surprise, somebody else recently has a PCN for turning into Oak Crescent from Barking Rd.

I'm not sure if this is a temporary or a permanent change. Might be TFL behind it, to improve the flow of traffic on Barking Rd. Or it may be down to building works. Who knows.

So it might be best to ask the Council to cancel on the back of mitigation. Terribly sorry, I wasn't aware of the new restrictions, it's been possible for years to exit Ordnance Rd onto Barking Rd, now I know it won't happen again, and so on in that vein. Please use your discretion to cancel the PCN etc.

@cp8759 - We need to have a look at the traffic order. Might be Ordnance Road, Canning Town, E16, (Temporary Prohibition of Traffic), Order 2024? Thanks,

Are we assuming that the back of the sign on the lamp post is a no entry sign. Shouldn't the council provide evidence of this. It seems quite clear that their camera has not been positioned properly and so this as you suggested would be mitigating circumstances.

I'm not assuming anything. I've had it checked. There are two "no entry" signs, one on each side of Ordnance Rd. You can see the back of one of the signs in the video.

The Council will provide evidence of the signs if it goes to the Adjudicator. But right now it looks pretty clear cut, your BMW sailed past the no entry signs. The driver should have turned right onto Malmesbury Rd in order to reach Barking Rd.

Where the signs are perhaps arguably deficient is that there is no alternative route sign telling you to turn right onto Malmesbury Rd.

Sorry Hashim, it doesn't work like that. At the PCN stage the council is not required to provide any evidence whatsoever, even the video is above and beyond what the regulations require.

@Enceladus I don't have any moving traffic TMOs for Ordnance Road, and while I'm happy to request one there's not much point: no entry signs are scheduled signs for the purposes of section 36 of the Road Traffic Act 1988, so no order is required.

We have received a PCN from Newham Council for exactly the same thing. What happened to your correspondence with the Council - did you manage to push through mitigating circumstances? We're just wondering about out next step.

Unfortunately Newham is one of the worst councils to deal with so I ended up paying.
