I wish to challenge this Penalty Charge Notice. I was not parked as alleged. At the time of the alleged contravention I remained in the driver's seat throughout and was attempting to leave the area following the heavy traffic caused by an event at Wembley Stadium. Traffic was extremely congested, and any brief period during which my vehicle was stationary was solely due to the traffic conditions, not because I had chosen to park. As soon as traffic allowed, I continued driving away. The Civil Enforcement Officer was unable to serve the PCN because my vehicle was already moving away. I respectfully ask the Council to exercise its discretion and cancel the PCN, as there was no deliberate parking contravention and any brief stop was unavoidable due to the exceptional traffic conditions.

The contravention is footway parking and the pictures do seem to show this...

What were you doing off the carriageway?

Looks like you drove down the kerb to try and avoid traffic and had to stop. Can't see any defence here.

I wasn't trying to avoid traffic. I'm a licensed PCO driver and had just dropped off a passenger. I pulled over briefly because I was checking my navigation before continuing my journey. The vehicle was stationary for only a very short time and there was no intention to park.

I'm aware the photos appear to show the vehicle on the footway, but I'm looking for advice on whether there are any procedural issues with the PCN or whether the evidence establishes the contravention, rather than debating my intentions.
