I think the timeline is as follows:
29/05/2026 – PCN received.
09/06/2026 – I submitted a challenge via the Waltham Forest website on behalf of my fathe( see below) I did not receive any confirmation email or acknowledgement letter afterwards. Perhaps this is where I've gone wrong? Is it possible that my representations were not formally submitted?
07/07/2026 – I received a letter from H. Ali requesting an authority statement from my father. I haven't responded yet, as I wanted to seek advice from this forum first.
08/07/2026 – I then received a Charge Certificate.
This is letter I submitted on 9thjune :
I make these representations on behalf of my father, the registered keeper and driver at the time, with his authority.
Having reviewed the CCTV footage, I respectfully request that the council cancel this PCN. The vehicle's presence within the box junction was extremely brief and any stationary period, if present, was momentary. I would ask the council to consider whether this falls within the principle of de minimis, as any alleged contravention was trivial in duration and did not cause any significant obstruction to other road users.
In addition, my father has since been assessed by mental health services due to concerns regarding cognitive decline and memory difficulties. As a result of these concerns, he has now ceased driving altogether. Whilst I appreciate that this may not amount to a formal ground of appeal, I would ask the council to exercise its discretion and take these exceptional circumstances into account when considering this case.
Should the council require supporting evidence regarding my father's mental health assessment and cognitive difficulties, I would be willing to provide relevant medical documentation.
In the circumstances, I respectfully request that the PCN be cancelled.
