Hi,

A disabled passenger was being escorted out of the vehicle and across the road into the bank situated across the road. The driver did not stop on the same side as the bank due to turning buses (although once the buses make the turn they do shift over to the right and stop as seen in one of the images).

Can you expand on this activity, please, because the No Loading restriction bars you parking using a BB, but alighting a passenger is the other exemption that applies to everybody not just BB holders. You seem to be describing "assisted boarding/alighting", but we need more narrative on what went on.

Although the driver has the use of the BB - it was not used.

The vehicle stopped as pictured, driver assisted disabled passenger into the bank to the cashier desk and in that very short time by the time the driver got back to the car the ticket was printed. The ticket was not placed onto the car as the driver said they were not accepting it, got into the car and drove off.

OK, so you received a postal PCN because you drove away before the PCN could be served. "Driveaways" were dealt with in the Traffic Management Act 2004, with the result you have experienced.

As you have a postal PCN, there is no Notice to Owner stage. I suggest you submit reps on the basis I described earlier, namely you were escorting a disabled person to the bank, and found the PCN when you returned. State that "boarding/alighting passengers" is an exemption to the yellow lines. Also state that where a passenger needs assistance to his destination, the driver may assist that person on the basis of "assisted boarding/alighting", and you therefore expect the PCN to be cancelled.
