Urgent Tribunal on 8th of January

Hello Guys

First of all- Thank you for creating this platform. I am sure you all saving lives. I am new and posting something for the first time and would appreciate your support. Let me elucidate the agenda as following:

PCN with Barking and Dagenham and the contravention was- 52J (Failing to comply with the restriction on vehicles entering and waiting in a pedestrian zone (CCTV Enforcement) due to same medical reason (mental health). I have got an hearing on 8th of January. Could I obtain some advice or assistance on this? Please find the attached PCN with this post

You've redacted the PCN number and vehicle reg when you were specifically reminded not to in your previous thread. As per the READ THIS FIRST - **BEFORE POSTING YOUR CASE!** sticky post at the top of this forum.

The Private Ticket forum has slightly different rules.

And please post up the Council's "case summary" from the evidence pack. And the notice of rejection and your formal representation against the PCN to the Council. And also your submission (case) that you uploaded to the tribunal, or have you got one prepared?

Thank you for the clarification. I have now attached the documents as per your suggestions. For tribunal- I have submitted the same representation. I have not prepared anything else.

I would advise phoning for an adjournment - today. No reasons are required.

Re mitigation: I would suggest all appropriate medical evidence to be provided to the adjudicator who may well find it compelling enough to make a recommendation to the council.

OP, IMO this doesn't read well if, as appears to be the case, you're pinning your defence on feeling nauseous. Your argument is going to need further work.

Thank you for your reply. Whats your suggestion at this point then? Should enclose any further documents like being off work (5 months) for the same medical reasons, medication etc?

IMO, an adjudicator would not warm to your case if you say that you've had a condition for at least 5 months which causes you to stop exercising the diligence required of a driver and yet you still drive.
