Hi good people of FTLA,

I was recently stung with two PCN fines, coming to a total of £260.

The fines were for PCNs received from parking in the same spot – on two consecutive days, in two different hired Zipcars.

Unbeknownst to me, my road was closed and the parking spots I usually park in weren't allowed to be parked in on the days I parked there.

While there were signs advertising the road's temporary closure, I parked at night on both occasions and left the car there until morning, so I didn't see.

Frustratingly, Zipcar have paid both the fines and passed the fee onto me. Because they paid late I had to pay full whack. And then Zipcar had the cheek to add a £30 processing fee for both! Meaning I'm down £320 for an honest error.

I have to try not think about what the money means to me otherwise I get upset. It's completely demoralising.

the hire agreement is important regarding what Zipcar say exactly re fines and administration charges. There maybe unfair terms or they may have acted contrary to their own terms.
pics of the signage would be helpful if you have any.
others will comment on your next steps

Zipcar state: "You are responsible for paying any parking tickets and moving violations incurred during your reservation. If we receive a notice and process a violation, you will be charged a £30 processing fee in addition to the fine itself."

I presume you left the car parked and didn't see windscreen PCNs.

What happens then is a month later Zip is sent notice to owners for the full amount. How it deals with these is between you and Zip as they are not your PCNs.


there is also the issue of whether zipcar have fettered your right to defend yourself against the pcns. in particular if they failed to act promptly and caused the payment to increase.

Zipcar operate a "flex" system in London, which means you can drop the car off, lock it via an app, and leave it for the next person to pick up. So I didn't see the PCNs as I wasn't the next person to use the car.

This was Zipcar's response to my email asking for clarification:

In addition please be kindly advised that when a penalty is first issued and placed on the car there is usually a 14-day window within which a reduced rate of 50% is payable. However, we only received the Notice To Owner for this violation, so it was settled and applied to your account at the rate it was received. And as the liable driver you are responsible to cover the cost set by the issuing authority.
 
We understand that this is a frustrating situation, but we need you to remember that PCNs are not issued by Zipcar, but by the local authority. We try to accommodate our members as best we can, but we, as a company need to recover the costs of these fines from the members responsible.

For the admin fee of £30 they really should make reps asking for the discounted penalty so you'd only pay £65 if accepted by councils, which are all for encouraging car clubs.

We've seen this many times with Zip and I'm not sure there is much you can do about it given the T&Cs. 

I don't quite follow, but if I do then something's wrong with this system because only single PCNs were issued. 

These contraventions occurred in two different Zip cars at the same location. The suspension was 25-27 Nov.

Can you flesh out exactly the sequence of events.

Zip say they did not become aware until the NTO stage and you didn't see the PCNs. So can we presume that at least the first car was driven away by another private person(not employee of Zip)who ignored the PCN? There doesn't seem to be any reference in Zip's system to drivers checking the cars when they commence hire and to bring to Zip's attention such things as PCNs stuck to the windscreen.

so who is responsible for the car once parked for the end of hire?
Another driver could potentially hire it in a short time or even immediately. the person leaving the vehicle at end of hire period may well not return to it so would not see any PCN.
