We need to see your representations. Reading your narrative it seems that the following took place: -
- You and your wife, (the BB holder), arrived at the location and you parked the car.
- You displayed the BB plus the time clock
- your wife walked off somewhere
- you remained with the car and a CEO turned up on his patrol
- you spoke to the CEO
- the CEO issued a PCN as the BB holder was not present
- you drove off and picked up your wife from another location.
Frankly, I'm not sure of the law on this, but consider this - if you had not been present at the car, and had accompanied your wife to where she went, would the CEO have been justified in serving a PCN ? I don't think so. Similarly, if you had accompamied your wife to her destination on leaving the car, and then returned on your own, to depart and pick here up later somewhere else, the BB was surely being used for its intended purchase. So I think the PCN is unjustified. However, see what the others say.
