34J - Being in a bus lane - Clapham Park Road - £130!

Hi everyone,

I'm new here but thanks for your help in advance!

Today I was issued a 34J - being in a bus lane from Lambeth council on Clapham Park Road. It happened on the 05/10/2024 at 9:49am. I remember waiting in the lane at a red light - a cab driver pulled up alongside me and mentioned it was a bus lane and that I needed to reverse and not go through the red light which I didn't.

Are there grounds for me to appeal this? £130 seems quite excessive for a short stint in a bus lane. I only got a car in September so I could argue that I was new to driving in London etc.

Any previous experience with this/advice is greatly appreciated.

This should be the second document received. Did you get a PCN in the post?

Hi,

I didn't get a PCN in the post. I hire my vehicle through Octopus EV and they receive all mail first and forward it on.

Does it look like this is the second letter?

My name and address. Octopus told me a while ago that all penalty charges / parking fines go to them and they forward it to us.

Maybe they asked Lambeth council to resend the letter addressed to me?

This is a bit odd. For rented vehicles liability cannot be transferred. Hoever if the lease effectively makes you the keeper and there is a sufficient degree of permanence liability can be transferred by treating you as the keeper. To see if there is we needd to see the entire lease. It might be easiest to send it to me by email to mrmustard@zoho.com to study in detail in the new year
