Tooting, code 46 stopped where prohibited on a red route, O/S 85-88 Tooting High

I stopped in a bay on Tooting High St at 9:54. I was there for probably a minute before I looked up and saw the sign said 10am-4pm and thought shoot! Drove off and came back at 10am but still got a ticket. Any hope in appealing?

You need to see their video evidence. You'll see how to request a DVD in the PCN.

IMO, the following are germane:

The sign does not face oncoming traffic and therefore cannot be read before stopping.
You could not see the sign without either exiting the car or leaning across from the driver's position. Had you exited the car, then making it safe e.g. putting handbrake on with or without stopping the engine, undoing seat belt, checking side mirror to ensure it was safe to exit, getting out, going to the sign, reading it, checking whatever timing device you had, returning to car and  moving away would have taken >>> more than 1 minute. Did you exit the car? If not, why and how did you read the sign etc. etc.

In short, your account and their evidence suggests you were stopped for less than 1 minute. Given that the sign does not face traffic and that you are allowed sufficient time to read the sign, then IMO this would likely be considered de minimis by an adjudicator.

But the video will reveal all.

Thank you for your reply. I received the cctv footage today and it only shows from 9:53 where I am parked up with engine still on as the lights are on but you don’t see what time I arrive. It does show me driving off just at it turns 9:54. My trip log doesn’t show what time I stopped possibly because it was such a short stop but it does show my final destination which is back at the location at 10:00am which supports what I say about looking up and seeing the sign and driving off and coming back. My trip log also shows approx what time I could have got there with the distance travelled and that is around that time (approx 23 min drive and I left at 9:32). I plan to appeal but is it worth me doing and is there anything specific I should point out? Thanks again

When appealing a charge like this, not sure what to select from the available options.  Either The Traffic Order was invalid or Any mitigating circumstances you wish to raise.  I don't want to select the wrong one and they immediately reject my appeal. What is usually best for situations like these?  Thanks

Select "The contravention did not occur", because you had to stop to read the sign, which was not facing the direction of on-coming traffic, then seeing you were outside the allowed hours, you drove off.

The evidence is the CCTV. Evidentially you were NOT stopped prior to when this is shown by the CCTV i.e. when it commences.

I've set out what I think your argument should be.

IMO, DO NOT speculate about anything other than what's in evidence.

As can be seen I stopped at *** unaware of the Red Route exemptions because the traffic signs was placed parallel to the carriageway..

We're blind after this because only you've seen the DVD. However hard you might try, attempting to convey everything shown in the CCTV using words alone is, IMO, a fool's errand.

Can't you post the DVD?

Thank you both. I literally just sent it using the Contravention Did Not Occur option. I just spoke about the CCTV which shows me driving off however it turned to me when I was already pulled up but my lights were on and my trip log shows the time I left my destination and would have arrived there which was at that time.

I said:

“I could not see the sign stating “No Stopping.  Except between 10am and 4pm” as it was not facing on-coming traffic. I only became aware of the sign once I had pulled up in the parking bay.  As soon as I saw the sign and realised I was too early, I drove off immediately, as shown in the CCTV footage. I returned to the bay at 10am, also confirmed by my car trip log which I have attached.

My trip log also confirms that I left Thornton Heath at 9:30am and with the distance travelled, would have arrived in Tooting just before the camera captured me, which is why my lights were still on as shown in the CCTV footage.  As soon as I saw the sign and that I was outside of the permitted hours, I pulled off and returned at 10am.”

I received a reply from TFL today and thankfully they have cancelled the PCN.
