Parked in EV bay while not charging?

Hello, I parked in an EV charging bay for a few minutes, intending to charge.

Phone died, went into sports centre next door to get a bit of charge, and got ticketed when came back to car.

Wondering if:

 1) there's any 'reasonable' defence to this?

 2) I also parked with front wheels slightly outside the bay so could I claim that they used the wrong contravention code?

Thank you for your thoughts. Feeling stuck at the moment..

Presumably it was one of those bovinely stupid chargers that needs an app. Did you charge the car when you got back ?

Yes it needed an app hence needing to charge my phone. No I didn't charge when I got back as I was so pissed off about the PCN so I left.

A pity, because it would have supported your case of needing to charge your phone. Anyway, submit reps based on what you've told us. If you look on the back of the PCN somwhere, it usually tells you they'll re-offer the discount if they refuse your reps.

Updating this thread with photos.

The question is whether I have grounds to object that phone ran out of battery and I got ticketed while I went into nearby sports centre to charge it.

Also, can I claim wrong code because my wheels were sticking over the front of the parking bay?

I have just looked at the PCN detail on Lambeth's website. The signage says just "Electric Vehicle Recharging Point. Max stay 4 hours. No return within 2 hours".

It doesn't say "vehicle must be plugged in or charging". What do you think about that as a grounds for appeal?
