Southwark 50r contravention - prohibited right turn
« on: »
Hi guys,

I received a PCN for making a prohibited right turn from Lower Road onto Neptune Street, google maps link below:
https://maps.app.goo.gl/8mHt7VdKyyK2tkFf6

I did perform the turn and was driving the vehicle etc so can't really appeal on those grounds, but the no right turn signs seem pretty far away from the actual junction and it was dark with not great visibility so is it worth fighting this?

Scan of the PCN is attached.

Two NRT signs, one each side of the carriageway and about normal I'd say, so I think you'll struggle but submit reps anyway on the basis of your narrative here.

There is no scan of the PCN. Please read this and update your thread accordingly: -

The video shows your car turning right into the street concerned.

This is their sole evidence of the contravention, but doesn't show you passing a No Right Turn sign.  However, this is no bar to them enforcing the PCN, unless you can prove that the signs were not present, or they were damaged or not seen due to obscuration (tree foliage etc). However, assuming the GSV July 2024 view is still the same today, you'll find it difficult to refute the PCN IMHO.

This does not mean the matter is yet closed, because the enforcing council must manage the enforcement process such that their duties laid down in the applicable Act and associated regulations are adhered to. So wait a bit to see if anybody suggests such an approach, but don't miss any deadlines on the PCN.
