Author Topic: Code 52m Maze Hill SE10 / Tom Smith Cl SE10 - Failing to comply with a prohibition on certain types of vehicles  (Read 845 times)

Received a PCN for getting entering into Maze Hill SE10 / Tom Smith Cl SE10. I entered Maze hill from Charlton Road to collect my wife and kids from Greenwich park (a route which I very often take). After I collected them from the bottom of the park near the playground, I used Thomas Close to make a 3 point turn and go back up Maze hill towards Charlton Road. At this time the camera took a picture and video of me. To be precise it captured me entering Thomas Close from Maze Hill, but not exiting less than a minute after.

I made an appeal explaining I did a 3 point turn and did not exit Maze Hill to Trafalgar Road but my presentation was rejected.

I'm attaching the evidence by the council, my appeal and the rejection letter. My question is do I have ground to appeal to a traffic adjudicator (London Tribunal) or not. Since there is no way to make a 3 point turn on the nearby Park Vista road it's closed for entry from Maze Hill the only way to go back uphill (towards Charlton Road) is either to make a U turn on the road which I don't feel it's safe to do.

        Answer : 'I wish to challenge PCN GR23742787 on two grounds. I was collecting my wife and 2 kids from Greenwich Park playground, collected them from Maze Hill, and used Thomas Cl for a 3-point turn to go back up Maze Hill to Charlton Way (camera logs would show me entering and quickly exiting Thomas Cl and going back on Maze Hill upwards). The restriction aims to stop through-traffic between Trafalgar Rd and Maze Hill, but cars already descending Maze Hill have no safe way to turn without Thomas Cl. A 3-point turn on Maze Hill itself is virtually impossible. Additionally, while signage exists uphill  on Maze Hill (southbound) from Trafalgar Rd, there is none for drivers going downhill on Maze Hill (northbound). Given these circumstances, I kindly request cancellation of the PCN.'

The PCN was issued to your vehicle because it was seen driving through an area where certain vehicles such as yours are not permitted do to so, as indicated by the signs.

We have investigated the circumstances raised in your correspondence and have made the decision not to cancel your notice. The reasons for our decision are set out below, along with the options available to you at this stage.

You have stated in your correspondence that you were collecting your wife and children from Greenwich Park and that you immediately exited the restricted route.

Although I appreciate you may have turned your vehicle around immediately after entering, the contravention occurred as soon as the vehicle was seen to pass the restriction signage, therefore, this holds no bearing on the case.

It remains the driver's responsibility to make sure that they familiarise themselves with the rules of the road by checking the road signs. I would add that the responsibility lies with the driver to be aware of, and to adhere to the relevant signage without contravening the restrictions in place.

I can confirm the signage for this location state that motor vehicles are restricted during the hours of 7am-10am & 3pm-7pm from Monday to Friday, except for authorised vehicles. This is part of a Neighbourhood Management Scheme that started on 02/01/2025 to improve the air quality, road safety and reduce the non-local traffic, where certain roads prohibit motor vehicles during the operation hours.

As your vehicle was seen driving through an area certain vehicles such as yours are not permitted to do so, the PCN was issued correctly.


Since it's asked about safety and the answer I got was pretty standard and bland (as that's answer they always give you, that it's your responsibility to adhere to the rules and bla bla) is there any grounds to pursue further with an adjudicator? The placement of the modal filter is very tricky and I've collected other people's opinion about it as well (not that it's related to this particular PCN)
