Sheepcote Street - Birmingham PCN Bus Lane 34J
« on: November 16, 2024, 05:22:50 pm »
I recently began driving into the office after many years in Birmingham and park at this Utilita area car park. Signage as you leave is very awkward as it is a mini round about as you exit the car park. To make this worse I have been driving into the office once a week and doing the same for the last 8 weeks and received my first notice from the first week of September only today!!! This was 69 days ago - what are my options around appealing this? I am fully aware I have made the mistake but the fact the time lapse of the penalty coming through has not helped me to learn from my initial mistake. What are the rules of a PCN being issued from the offence? Is there anything I can appeal on my continuing contravention in error.

I am wondering if this will be an isolated capture of my dumbness (pay up and hope no more come through) or should I call up the Council and fess up to try ease the pain by admitting fault to the multiple offences.

Lease company have asked me to wait 2 weeks for the letter to be posted to me. I logged in using the details they provided me and it is not even allowing me to pay the £35 but instead the full amount of £70. I was hoping to use that to appeal and state the above.

Photograph as exiting car park attached and Google Maps location here:

Appreciate ANY advice as this is really sound like an expensive mistake which I never managed to rectify quickly.

Thanks for quick response. They have a payment line which is automated and no idea how to actually speak to someone. Will try call in to actual office and try get directed to someone.

Is the car leased.

We have another recent case here as you've seen.

https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/pcn-bus-lane/msg37647/#msg37647

Yes it is leased and for me that in incredible that the driver would be further penalised for the miscommunication between leasing company and the driver.

Have you received a PCN in your name at your address?

Sadly the PCN has arrived to my home address see here https://imgur.com/gallery/9u2IgIn

So how do you guys feel I should tackle this?

They have given me the chance to pay 50% but what is going to impact me is still the additional tickets that will come after this.

Should I call now now I have the ticket and fess up to rest I am expecting? I want to argue that because it took so long to receive this one I stupidly carried on offending and not correct my behaviour.

Any advice will be appreciated guys.

Thanks for reply John and I got through to the council and they said they only see one PCN on the system (just this one).

As expected this has been delayed as they struggled to get my details from the lease company/DVLA.

I am thinking to pay this one and hope for the best now that no more come through? It is just random which days they sample the cameras if so make no sense why there are no others for me when there should be..

Has the PCN your own name & address or did the lease company forward it?

Can only see part of one side of the PCN: Please post all sides of the PCN, redacting only yr name & address.

Please also download and post here a copy of the video.

Also ask the leasing company if the received a letter from (Notice of Acceptance) from, Brum accepting the company's reps and cancelling the original PCN.

Did council check the VRM and not your name? They should report any PCNs against the VRM.

Thanks for replies again guys. Yes it has been sent to my address under my name. Well the guy said he couldn’t see anything else for this. Now I’m wondering if he meant the driver and address rather than the VRM. Will call again tommorow and check that.

Thanks in advance

We've seen this location before.

The car park operators have not seen fit to put a sign up regarding turning left out of the car park, but the council have put up a sign, albeit on the other side of the street: -

It must be a nice little earner for them !

Yes mate it’s a massive earner and I read it takes in millions since it was enabled in 2021!

So I called in again to check and I have just one more other violation pending on my VRM from end of October which they just sent to the lease company. This is complete madness as I checked my credit card for the days I parked and definitely did between these dates.

However, If I have got away with 2 penalties I’ll take that. Am I right in my thinking to pay this one (reduced rate £35 till December 13th) and then appeal the next one and say because of the delay in me being an opportunity to learn from mistake I reoffended?

Thanks in advance.
