I had paid for parking. The car park is quite large. I had a disabled passenger with me so wanted to park closer to the footpath. All the normal bays were taken so I had parked in disabled. The road markings are on the floor but there are no signs requesting badge etc. There are no pictures along with the PCN nor on the website from what I can tell of the offense

How did you pay? There is a large information board right next to the payment machine, which (at least according to the Google Earth picture) says that "A penalty charge may be issued in the following circumstances"...

"5. Parking in a disabled bay without displaying a valid disabled badge"

It is surely understood that if one parks in a space marked for disabled, that one has show your bona fides by displaying the BB ? Is your disabled passenger a Blue Badge holder ?

This GSV view dated July 2023 shows a small group of bays for disabled. There is a pay station very close to them. with a conditions and tariff board. Does that show the same thing as the one at the end of  the drive-in road ?

Well no, the bay might be advisory. However in this instance GSV does suggest that the terms and conditions board here https://maps.app.goo.gl/UWo9yVz3sty7vqi8A requires a blue badge to be displayed in disabled bay.s

@Hk can you please post the back of the PCN? Also please contact the council and ask for photos, in the meantime I'll get the parking places order.

No reply from @Boomer, but here is The Ribble Valley (Off-Street Parking Places) Order 2020.

cp8759, i think that you mean @Hk, but the linked order was quite interesting anyway.

Funnily enough, i have just spend the last few days in Clitheroe - but for the Food Festival rather than immersing myself in the parking experience ;)

I'm still trying to identify the breach of the order because 19(d), which seems to be the reference condition, only appears to stipulate that a vehicle parked in a disabled bay but without displaying a BB etc. is not entitled to park without time limit or payment.

But you did pay.

And as for their General definitions regarding 'owner', there isn't a definition in the 1984 Act which applies in the sense it's used in the order. And it's unnecessary because enforcement doesn't take place pursuant to the provisions of an order but to. in this case, the TMA. But hey-ho.

He never logged back in after 6 March, so I imagine he gave and and paid and never bothered coming back.
