Hello all,

I know I am posting this very late, due to circumstances I was caught up with time.

My mother was driving my car and dropping my sister off at Ilford station, due to the medical condition of my sister, she has issues with her knees and can't walk far without aid, my mother dropped her off at a bay infront of the station without knowing that it wasn't a bay used for drop off. My mother was there to drop my sister off and left but she was photographed by the traffic warden but did not leave the ticket on the vehicle and who also stated she was there longer than she was.

Is there any appeal to this or should we just pay it?

Also to note, if this helps, my sister does receive PIP due to her knee condition and she did score points on the moving around section, she does not have a blue badge because another family member had one till it expired recently and we didnt pay attention to renew it.

Any help is greatly appreciated, I think I may only have a couple days to submit an appeal, apologies

The signage is not compliant, supposedly local authorities employ highway engineers but I can't help but look at this and wonder who comes up with this s*&t. The bay markings should be red not white, and the double red lines should not be there at all.

Is your sister applying for a blue badge? Showing that an application is in progress would help.

Don't worry about the discount, as long as you submit something before midnight on Tuesday the discount will almost certainly be extended anyway.

Hello and thanks for replying

My sister has not yet started the application for the blue badge but she is having a letter made to back up the application when she starts it, however the GP has said this can take up to 4 weeks to be done and she only made the request last week Thursday I believe.

Would there be another way around this without the application proof?

Thank you for letting me know it's until Tuesday midnight, was worrying I had till tonight

Any relevant paperwork could help: anything in writing you have from the GP regarding the knee condition, the PIP paperwork, anything of that sort.

I can certainly gather all of that from her. I believe she has an old letter from this year about her condition and her PIP entitlement letter also.

After that's gathered, what's the next step?

If anyone else is able to help draft a representation for me id greatly appreciate it. I did try to come up with a draft but unsure of whether to add the bit about the signage being wrong or just go for my sisters condition.

CP did say that the last appeal date would be last night however after checking the portal, the discount price is still there. Im hoping i can still submit something within this discounted period.

Here you go:

Dear London Borough of Redbridge,

I start by saying that I apologise for any inadvertent contravention of the restrictions, the layout is somewhat confusing because red route bays are not permitted to have double red lines running through them, normally a bay on a red route that has white markings is available for use through the time that the red route is in force (and conversely a bay that is only available at certain times would have red bay markings but still no red lines along the kerb).

On this occasion I was taking my daughter to the staton, owing to her medical condition she has issues with her knees and can't walk far without aid, so I sought to stop her in the bay as close as possible to the station so I could help her walk the short distance remaining.

My daughter is in the process of applying for a blue badge, she has starting by requesting a supporting letter from her GP but I am told this can take up to four weeks and it was only requested quite recently.

I attach what medical evidence is available to me, and her PIP entitlement letter which confirms a score for moving around of 12 out of 12, which has resulted in an award being made for PIP at the enhanced rate.

I appreciate this is not a substitute for a blue badge, but in practice if she had started the blue badge application process earlier it is all but a given that the application would have been granted, and it would have then been permissible to stop on a red route for the purpose of alighting from the vehicle.

I trust that in the circumstances, you will agree to exercise your discretion not to enforce this penalty charge.

In terms of a blue badge application judging from cp's response above she automatically qualifies.

Hello,

Coming back to this

I did receive a Notice of Rejection, due to me being away im only catching up with this now. I am maybe a day away from when the discount period ends but unsure of what to do since its been rejected.

I have taken in the above comment and asked my sister whats happening with the application, she said she was also told by a work colleague that she should automatically be eligible for the badge, she said she has put in an application so we are waiting on that now.

I am attaching the PDF. Would it seem the likely route to pay or go to the tribunal? WOuld the tribunal see this is as a fair response of why the car was stopped there?

@unknowndriver if it were me I'd be taking them to the tribunal, as the layout is pants. Double red lines mean to stopping at any time, and as they say stopping makes the vehicle eligible for an instant PCN. But it's also a goods loading bay, so you must be able to stop to get out and look at the sign. So which is it, a loading bay or an instant PCN no matter what?

That being said the outcome is not guaranteed, all appeals carry an element of risk, so you need to decide whether you wish to pursue this.
