Hoping that this is going to be a straightforward appeal.
Yesterday, we were surprised to receive a PCN (At bottom) on our vehicle after attending a show at G-Live with my young daughter. To make a long story short, the Pay & Display machine only accepted coins and we made concrete effort to reluctantly re-downloaded the RingGo app to pay the minimum charge of £4+ for 3 hours (I hate parking apps with a passion). We were only there for 1 hour 20 minutes.
After the PCN, we discovered that the RingGo app had used the default setting of our old number plate, which was sold in 2021. It is an honest mistake for not double-checking, however, I do not recall at any point, did the app ask to re-confirm the number plate. The parking code 73 stated "Parking without payment of the parking charge".
I have evidence that payment was made, with no intention of depriving the council of revenue. Is there a template for appeal?
My thoughts are:
- Evidence that payment was made albeit with incorrect number plate
- Evidence that the default number plate was previously owned by us (I am also looking for confirmation that we sold the car to prove we no longer own the car). Our previous car was also a Volkswagen so there are similarity to our current car.
- No signage/T&Cs on-site specifying number plates is required as part of payment (If paid by coins, no number plate is required).
- Inadequate choice of payments as expected machines to include contactless option.
- Most importantly for them, there were no intention to deprive council of revenue/loss of earnings.
I have several pictures of any signage in close proximity, even at the entrance and there were no T&Cs at all.
Grateful for any thoughts or guidance on appealing.
As a starting point, to use evidence of payment as first point then evidence of past ownership of the default number plate then point out it is clear that there were no intention to deprive council of revenue.
