RBKC - Code 11u Parked without payment – Iverna Court

Hello, and thank you in advance for your time and help,

TL;DR There are 12 bays, with a “resident parking” sign on one end and a “paid parking” sign on the other end. I am a resident and parked in a paid bay because I didn’t know the other sign was there, and I feel it was very unclear delineation between bays. What do you think?



In summary:
  • I have a residents permit in my local area.
  • There is a set of 12 parking bays on a local street
  • At one end of the bays is the normal sign indicating that resident permit holders can park there (“Resident permit holders only”).
  • Based on this, I parked in the middle bay.
  • I have received a PCN because, at the other end of the bays, is a sign indicating these are bays for paid parking (“Pay by Phone…”).
  • I did not see the paid parking sign when I parked, and did not expect that a sign near to where I parked would not be the relevant sign.


I have now been back to the street, and noticed:
  • The bays near the “paid” end have numbers in front of them (from 1-6). This includes a “6” in front of the bay I parked in.
  • However, there is no indication that these numbers mean that these are paid bays vs resident bays AND half of the numbers have worn off (bays “3”, “4” and “5” are almost completely worn off – see image).
  • There is a ‘double’ bay divider between what I infer are the paid and resident bays (see image).


In the link below I have provided four images. These show the “paid” sign (A), the resident sign (B), the car location (C) top-down and in street view. I have also provided one image showing one of the worn off numbers and a final image showing the “double” bay divider.

Here is where it happened on Google street view. In the street view, there is a bay “7” which doesn’t have a number any more (maybe there is one less pay bay and one more resident bay now):

Yes, the delineator, (double-dashed line at right-angles to the kerb is there to separate the two sets of bays, one for residents the other for pay parking, but the signage is not good. In cases like this, the recommended signage that eliminates doubt, (or almost !!), is for the two bay signs to be mounted side by side  on a single pole where the bay delineator line is, with each sign's applicability indicated by an arrow, (left or right pointing).

I suggest you submit representations on this basis, and post up their inevitable rejection when you get it. Make sure you emphasise that you are a resident with a permit.  Why an inevitable rejction, ? Because councils know from previous experience that most people cough-up when they get rejected, not knowing the law and regulations, to get the discount and, frankly, to make it all go away.
