Trafford Council Code 01 – Parked in restricted street

Hello all

Posted this on Pepi last week and was advised to post here but did not get an authentication email so couldn't. cp8769 over there managed to get me activated her, so that you for that. Even though I have submitted my rep's I will post it here, for reference I suspect as I think I may lose my appeal!


My OP from Pepi:

My better half & I attended Old Trafford for a game on 26 August and when we got back to the car we had a ticket. Unfortunately, this was misplaced and only managed to find it late last night so wanted to post here to double check before we send in the appeal tomorrow.

The main grounds of the appeal are:
1. Elsinore Road is not in the restricted zones as shown in the attached map on match days
2. There was no signage on the road indicating any restrictions whatsoever

Is there anything else anyone can see please?

Would also like to add that we were parked wholly on the pavement as it is industrial so they are huge and everyone parks there all the time, we have done for a few years without issue. So I think had they used the relevant penalty code for that we may have been stuffed but they didn’t so assume they cannot change it now (hence why I have edited the PCN & reg).

This was posted in reply but caqme after I submitted my appeal, I was thinking whether I should email them with this and ask them to add it onto my grounds:

Please give us the PCN number and number plate, and also post the back of the PCN in a decent resolution. There is a known issue with Trafford PCNs that we can probably use here.

I'm not sure phantomcrusader's argument has legs, the wording for code 01 has been in use for over 20 years across the whole of the UK and I don't think it would get anywhere. The traffic order is not really helpful for these purposes because most people who get a PCN don't start looking up the traffic order for definitions, indeed I dare say most PCN recipients have no idea of what a traffic order is.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister.
