PCN Wakefield Council no valid ticket, Pontefract code 83

hello, this morning I pulled into the usual car park I use in Pontefract - Newgate South. I opened the MiPermit app on my phone, and clicked on the nearest choice icon. So the Newgate South carpark seemed to show and I paid for a full day from 8;09 until 18:00 at the price of £5.30. Upon returning and finding the PCN and checking the app the ticket I bought was for Newgate North carpark. A car park I have never parked in and as I was in the bay of Newgate South car park and clicked the nearest icon I fail to see why it hasn't shown the top choice as south but rather North? So the contravention is code 83 Parked in a car park without clearly displaying a valid pay & display ticket or voucher or parking clock.
I'm annoyed and have considered emailing them to point all this out and it was a genuine mistake but I have come here first as I am not fully confident of the process. TIA [ Guests cannot view attachments ]

This is where councils either play nice or not and we expect them to be nice especially if apps they use locate you in a slightly wrong location and parking is paid for. A lot of councils simply let you off for a first honest error with location, VRM.

Wakefield's policy from a few years ago is encouraging.

Can you tell us where you were standing when you invoked the PbP app on your phone, please. Did you let the app find the car park using satnav or was your selection a case of "fingeritis" ?

I had a look on a GSV satellite view of the two car parks, and the rear of the south car park is only a few yards, (34), from the northern one, with Elm Terrace lying between the two car parks.

hello, I was in my car in the bay. I was parked backing onto a wall and yes the North is only separated by a few buildings. On my MiPermit app it has the last 10 receipts and there is a history of me parking there and today when I go again I will make sure that the car park is put in the app's favourites and triple check it is the correct car park! that being said it has not happened before it normally shows the nearest and it has previously shown the correct car park. Until Tuesday!

The bay I parked in, has a high brick wall at the back of the bay - looking at the map as you say it is only separated by Elm Terrace, which is where my car was backed into.But I was sat in a stationary car as I pay before I leave the vehicle. When I returned to my car after work, and saw the ticket and read it in my car I thought the ticket was a mistake until I went into the app and discovered the ticket that had still over an hours time left on it was showing as North

So should I appeal with my receipt for the day - I did pay for a full-day stay and I have receipts for previous South stays.

How can the signs still specify 'Display' when non-display is permitted?

Every day you commit the alleged contravention!

Code 73: Parked without payment of the parking charge is the correct contravention IMO when a payment is not made in respect of a vehicle and/or car park.

As a point, are the tariffs the same in both car parks and are P&D transferrable?

Leave the above arguments dry until you've tried the more simple argument.

Are you the registered keeper with current DVLA data?

The price is the same rate for the car parks over 4 hours it's £5.30 for the day.
I'm not sure P&D is transferrable. if I had realised that I'd paid for the north car park I would have bought the south car park and tried to get a refund of £5.30 for the error.

I am the registered keeper with the current DVLA, yes.

Then I suggest the simple, 'I made a mistake but no harm done first time pl exercise discretion' argument on its own.

Dear Sirs

Re PCN <number> dated <dd/mm/yyyy> served at Newgate South Car Park, Pontefract

I respectfully request cancellation of the above PCN due to the following circumstances that caused me to pay for Newgate North instead of Newgate South.

On the day concerned, I parked my car right at the back of Newgate South car park and used my mobile phone app to make payment, which was successful.  I did not notice that the app, using GPS satellites, had identified the incorrect car park. I paid the daily charge as normal, (it was the same I had paid many times before), and went on my way. On my return to the car park I was astonished to see that a PCN had been served.

Newgate North and Newgate South car parks lie on either side of Elm Terrace, and are thus only a few yards apart, so I suspect this is what caused the error on my parking app. Clearly, now I have been alerted to this potential problem, it won't happen again. Obviously, the council have lost no money at all from my mistake, so I would be greatly obliged if you could cancel the PCN on this ocasion.
