Author Topic: PCN TFL - Stopping on red route - In a parking bay, but ticket issued by CCTV  (Read 180 times)

Hopefully you can help.

I've been issued a PCN for "stopping where prohibited (on a red route or clearway) - Aristotle Road, SW4

On the above date, I stopped in what appeared to be a parking pay, off the main road of Clapham High Street. The TFL images clearly show that I was in the bay, and both images are less than 2 min apart. I had stopped to collect a delivery from a shop on Clapham High Street. The parking pays are just before a the pavement narrows, so absolutely no traffic has been impeded and it isn't even a bus route. From what I can now see from Google images, the restrictions apply from 7am to 7pm, but with a window from 10am-4pm for loading. I'd need to go back to see what is actually there at the moment (but on bicycle!)

I've received the ticket, and its been issued by a CCTV operator. I've obviously googled and seen the London Tribunals case about TFL not being able to issue tickets by cameras in some circumstances, but it isn't clear whether it applies in this case. There is no reason a parking warden couldn't have issued the ticket in person. Its a quiet side road, 20mph limit, big wide pavements and I was in a bay.

Have I got any grounds to appeal on the basis of the tribunal about CCTV enforcement?

Helpfully, I'm parked where the white Polo is. I will say that the marks around the parking bay are now red, rather than white

It was decided recently at the High Court that TfL could enforce Red Route parking bays using CCTV although from my point of view the judgement looked a bit of a cobble, frankly, but of course the judgment prevails. So the PCN is correctly served. However you would seem to be exempt through the loading 20 minutes exemption on the sign. So please tell us all about what you collected and how long it took you. May I assume you are not a BLue Badge holder or any passenger with you ? That is the other exemption.

No disabled badge or anything like that. And I was collecting a rucksack from the bike shop opposite.

Has the judgement about not being able to use CCTV for parking bays been completely overruled then? As said, it was completely off the main road on a side street. No buses or HGVs go down there, and I’m stopped directly in line with the pavement in front, so it’s not as if I would be holding anyone up even if there was heavy traffic.

It does seem a particularly over zealous use of red route restrictions

I'm afraid so. However, you should still submit representations stating that you were collecting a rucksack from the store that you had previously paid-for on-line. This bit is important because just going shopping and putting it in the car is not considered loading.

Pity, red is the correct colour for a restriction which is not for the full extent of the red route prohibition - therefore white in GSV was wrong.

But as it's only a part-time exemption, what are those hours? If as per GSV, then you do not have a loading exemption because 17.21 is after the end of the exempted period which ends at 16.00.
