PCN suspended parking Hackney

I was given a ticket for parking in a suspended bay. This is where I always park and is directly outside my flat. The photo evidence with the ticket shows a suspension notice, but I hadn't seen this being put up, it wasn't visible when I parked there, and I was on holiday on the day the ticket was issued - the notice has now been taken down so at first I had no idea what the ticket was for. My car is parked as normal in a residents bay outside my flat.

I don't know if there's any standard protocol for giving notice of parking suspensions, but I received nothing in the post and no leaflet or other notice on my vehicle. This is Hackney council.

The suspension was for one day, 3rd September.  When did you go on holiday ? The suspension was for some filming, so not an emergency. So the sign should have been put up a minimum of 5 days before it applied.

Thank you - I went on holiday on 2 September. I don't remember seeing the suspension notice up at that point but could have missed it. I'd last actually parked the car in the bay several weeks before (I think 11 August) so wasn't actively on the look out for notices.

Probably nothing happened with filming as they may have relocated or towed your car to the pound if it was getting in the way.

The sign must have gone up when your car was in the bay and they keep a log of this.

Probably best to be a bit vague in the challenge - was away on holiday, returned to find PCN, didn't see a suspension sign before leaving. As a resident hope you'll exercise discretion etc.

Can you check with a neighbour if any filming activity took place.

The suspension was not for filming, but for change of use to car club bay, presumably because of filming requirements at the latter.

I seem to recall cases involving Westminster, where change of use requires a Temporary Traffic Order rather than straight suspension, but my recollection may well be faulty?

Yes you're right. You are also correct that this probably isn't a valid suspension as they can't change the use of a bay like this.

Hackney has form on this too. This is what it says:

Disabled bays and car club bays will only be suspended in exceptional circumstances – if you need to suspend such a bay, you will be required to suspend an additional parking space for the bay users; you will also be required to cover the costs of the alternative parking space.
