PCN Southwark 52m Rye Lane/Hanover Park
« on: »
Hello,

I have just received a PCN for the junction at rye lane and hanover park.

The signage just before the junction states the right turn is for buses only but doesn’t state anything about the restriction to traffic on the left turn. I was unaware and from the picture on the PCN it wouldn’t have been possible for me to see the restriction until I turned the corner onto it.

I had no idea I had done anything wrong, but the sign before the junction made me think I must turn left.

Do I have any grounds for challenging this PCN?

Many thanks

Well, on the face of it, yes, as it seems you have been led into a trap with no means of escape. However, whilst your streetview link shows this ridiculous situation, what is its date ?  because signage is key here to establishing a robust apppeal. Traffic signs should not, ever, lead you into a trap.

So you will need to explain why you would seem to have ignored this sign on your approach to the junction with Rye Lane : -

then this 2022 zoom shot, used because after reaching a point, GSV goes back to 2020 and the old sign: -

This tells us the restriction has been in place since 2022. Were you following satnav ? Fatal to rely on it in London, you must look out for traffic signs.

Yes I was following satnav unfortunately. I don’t often drive in London and was completely unfamiliar with the area. Silly of me but I must have missed that sign, but I remember seeing the one just before turning and making sure not to take a right.

Is there any hope for an appeal or should I just pay it? Thanks so much for any advice.

Use my draft as per the other thread. Paying now without making a formal representation=joiningThe Mugged Club.
I REGRET THAT, FOR THE PRESENT, I AM UNABLE TO TAKE ON ANY MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. THIS IS FOR BOTH PERSONAL AND LEGAL REASONS. PLEASE DO NOT PM ME UNLESS YOU HAVE POSTED YOUR THREAD ON THE FORUM AND I WILL ATTEMPT TO GIVE ADVICE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
