PCN served late?

I understand that councils have 28 days to serve PCNs from the date of the alleged contravention.

I have received a PCN today, 10/7, for an alleged contravention on 10th June. The PCN states "date of notice 08/07/2025"

I assume this is a simple out of time defence since 30 days have passed since the alleged contravention?

The PCN was deemed served on day 31.

It's been served out of time and is not a lawful demand under the relevant legislation.

End of as far as you're concerned at present, although perversely you still have to make reps to this effect.

If the authority wish to rely upon one of the exceptions then the burden falls to them to prove their entitlement so pl don't exercise yourself about this.

Hi again folks.  I appealed this on 11th July and have received no response aside from the "do not reply" email acknowledging that they've received my representations.

Am I best to assume they've cancelled it or to contact them to be sure?

Never assume!

You should be able to check on the Council's website the status of the PCN.  If it's still shown as live, then a follow up looks appropriate.

Thanks.  Checked and it is still on there. Tried the phone number provided on their email which, of course, is not answered, so sent a recorded letter.

So, wrote by recorded delivery asking for status of the PCN on 12th September. No response.

So, tried their phone number again. No answer.

So, went online, eventually found a web form that can (allegedly) be used to query the status of a Havering PCN. Filled it out. Message said response within 24 hours.

Guess what...  :)


No news is good news I suppose.  I'll leave them to it now. They've obviously got too much to do.

So I finally received a reply, link below

Is still haven't had a rejection letter (or any other "previous correspondence" from Havering) and so have no rejection code for making an appeal to the adjudicator.

What to do from here?

Are the name and address correct on the PCN and letter.

It looks like they sent a rejection you didn't get so they will probably now send a charge certificate and order for recovery.

As long as you did file reps you then make a statutory declaration you didn't get a rejection and then they must refer the case to the tribunal.

Or you can try asking them again for their response.

Just wondering if London Tribunals will accept a late appeal. Havering don't reoffer the discount, so it's a no brainer to take them to LT.

Thanks for replies. The name and address are correct on both documents.

I've used their online form thing again, requesting a rejection code.


Nothing else I can do at this stage I suppose.
