PCN - Rochdale - Code 21 - Parked In A Suspended Bay

Hi,


I think I may need to suck this one up as my own silliness. I parked in a suspended bay - I had thought ‘parking suspension’ meant that the normal rules, if any, for parking were suspended. Not familiar with the street, I recently joined the gym here and have been parking here for at least a month with that sign in situ (and others parked there too) without any ticket. So continued to assume it was totally fine but obviously had been lucky until now.


Reg and car colour are correct, however my car is a Suzuki and not a Seat. I thought this may have helped, but a quick search on here and I see that car make is not mandatory so perhaps not going to help.


Not sure if any relevance but on this occasion I was in there about 25 - 30 mins as I just used the sauna.


Anyway it’s worth posting on off chance, thank-you for any help.

If the bay is still suspended, please provide a photo of the suspension sign if you can, please.

The suspension sign seems clear enough. The sign includes the symbol for No Waiting, plus words No Loading, meaning the only thing allowed is boarding/alighting passengers, so not sure how you could have misunderstood this. So the contravention would seem to be made out.

The final question is, there are three signs for this lengthy bay, so how many suspension signs are there ?
Putting a single sign at one end of the bay could be regarded as inadequate signage, one on the central sign probably OK, and one at each end would be OK. A suspension sign on all three poles would give them a bullet-proof defence against inadequate signage.

Apart from the above, I can't think of anything else to support a credible representation, so wait a bit for others to comment, but don't miss any deadlines waiting, if you're minded to pay.

Interesting to see they have put the TTRO document on the pole. There is no legal requirement for this, but it must exist to support the suspension.

Thanks for your reply. I assumed that would be the case. Silly as it seems, I had thought that ‘waiting’ meant that - sitting and waiting within the vehicle, rather than actually parking and leaving it.

There were similar notices on two other poles as you mention, the one pictured was just the closest to where I parked.

Looks like it’ll have to be chalked off as a lesson learnt, but I’ll hang fire to see if there are any further replies.

It looks like it.  We normally recommend people submit at least an informal challenge on the chance that the council will muck-up their reply.

So it's up to you whether you do this. Have you anything that might mitigate the PCN at all ? Other aspect is council management of the enforcement process and whether PCN content is as legally mandated, but the PCN looks OK, but nobody else has spotted anything. So if you're minded to submit a challenge, make sure it's receive by them before the discount period runs out. This means they'll re-offer it if, (when !!),  they reject your reps
