PCN Red Route 46 - Mile End Road E1

Hi All,

I received a PCN for red route, please see pics attached.

There was no sign however on google maps i could see a sign facing oncoming traffic but i came from the opposite way.

I literally stopped there for 5 minutes as i went to get some water. Expensive water for sure!

Anything we can do with this?

@safeqaz all TFL's parking PCNs are currently open to challenge, but you've given us nothing to work with. As John says, please read the guidance here and re-post the PCN with the PCN number and number plate visible.

Also please call TFL tomorrow on 0343 222 3333 and ask for the video, they will send you a DVD in the post and put the penalty on hold while you wait.

Lastly please give us a link to the exact spot where this happened, the guide I've linked above will explain how to do this.

@safeqaz well there's no photos on the TFL website which is very odd. Have you ordered the DVD?

The double red lines do not have an upright sign, therefore service of a postal PCN is a procedural impropriety because the High Court has said that the requirement for an upright sign applies to double red lines just as it applies to single red lines.

However it would be useful to see the video before I draft anything.

@safeqaz you've missed the 28 day deadline and are at risk of getting a charge certificate and losing the right to appeal.

You need to go and make a representation right now, or else all is lost.

Go to https://tfl.gov.uk/modes/driving/challenge-a-pcn and put in a representations simply saying "the alleged contravention did not occur", if you're lucky they'll still consider it and issue a notice of rejection.

Because they (or a computer algorithm)  can take it off hold at any point.
So follow CP's advice.

Sure, but if they take it off hold and issue a charge certificate, you will have no grounds to file a witness statement with TEC, meaning you'll have no procedural route to get this before the tribunal and you'll be stuck with a bill for £240 which you can't challenge.

We've seen lots of people end up in this situation because they were waiting for the video and were sure the PCN would be kept on hold more or less indefinitely, but that is simply not the case.
