Dear Sir/Madam,
I am writing to make formal representations against the above Penalty Charge Notice issued for an alleged bus lane contravention on Cambridge Heath Road (2 Three Colts Lane to BG Road) on 22 January 2026 at 16:26.
On that date, I was returning from my nephew’s funeral, accompanied by my cousin, who had just buried his son. While driving back, I momentarily entered the bus lane to pull over and drop him off near his home. I exited the lane immediately once he alerted me to the restriction. This was an inadvertent and brief manoeuvre made under emotional distress following a bereavement.
The CCTV footage provided by the council does not show my vehicle entering the bus lane, only a short moment within it. This evidence is insufficient to demonstrate a full contravention under the Bus Lane Contraventions (Penalty Charges, Adjudication and Enforcement) (England) Regulations 2005, which require clear proof of entry and travel within the restricted lane.
I respectfully request that the council exercise its discretionary powers under Section 87 of the Traffic Management Act 2004 and Regulation 10(1) of the above regulations to cancel the PCN on compassionate grounds. This was an isolated and unintentional incident during a period of emotional distress, and I took immediate corrective action upon realising the error.
I trust the council will consider the circumstances and the proportionality of enforcing this penalty in light of the evidence and context.
