PCN received at Twine Court E1

Hi all,

Need some advice please.
I got a PCN at an estate road while I was parked in a visitor bay displaying a blue badge.
The bay did not have a sign like other visitors bay do in that estate.
The photos taken by the ceo does not show the registration number of my car.
And I also think the sign at the entrance is a lot higher than it would normally be.
The parking website shows ticket amount as £65 and not £130.
Please advise how I can best challenge this PCN I have attached everything below.

Can you please give us a link to the exact location on google street view, or at least as close as you can get?

The photos of the signage are a bit odd as they don't show where they are in relation to the car.

I have also requested the parking places order, oddly enough this estate isn't included in The Tower Hamlets (Off-Street Parking Places) (Consolidation) Order 2021, though it's possible there might have been a later amendment.

Yes your link is working, I have also got The Tower Hamlets (Off-Street Parking Places) (Amendment No.1) Order 2021.

There is nothing intrinsically wrong with the order or the signage, but we'd expect reasonable for the authority to exercise discretion for a blue badge holder.

What's the back story to the PCN? Was it your first time parking here or had you been before? Did you look for any signs when you got out of the car?

I didn’t see the sign when I entered.
It’s the first time I have been to the estate and did not know that tower hamlets estate had the same parking policy as the off road parking policy.
I did not see any sign for disabled bay when I drove around but this bay did not have any sign say visitors permit holders only or anything like that just marking on the ground.
I was only parked for a short period when I went to pick up My mum who has disability and the building does not have a lift so get ready and her down takes a long time.
Just look at the sign when I saw the ticket seems a bit high and also doesn’t the photos of the vehicle needs to show the vehicle registration number

It’s my mums.
Also I forgot got to mention the car is registered to my partner but I was driving don’t know if that makes a difference.

Sorry one last thing before I draft something, is it your mum who lives at this estate or was she visiting someone? In either event, does the person who lives there not have visitor permits? Or do they just not know anything about it?

The fact that it's your partners car doesn't matter at this stage, but at the Notice to Owner stage only they have a right to challenge the penalty, but they can give you written authorisation to do so on their behalf.

My mum went visiting I dropped her off and then picked her up,
They don’t use visitors permit and don’t know anything about it as they don’t get many visitors with car. And she went first time after covid as she has difficulty going up the stairs as the building does not have lifts.

But you've now said you've dropped her off, so it can't have been the first time? It must have been at least the second time?

There's a 19 minute observation time, that time needs to be justified in full.

How far was it from the front door to the car?

I dropped her off downstairs and the relatives took her up but I picked her up so I had to park up and go up to the 3rd floor and then get her ready and bring her down the stairs no lift it takes time to get her ready

Draft representation, there is no boarding / alighting exemption here so it's down to a plea for discretion:

Dear London Borough of Tower Hamlets,

I would ask that the council consider cancelling the penalty charge notice for the following reasons. I had dropped my mum off to visit some relatives who live on the estate, who are unfortunately unaware of the parking provisions as they don't get many visitors who have a car. When it was time to pick her up, I stopped briefly in the bay with my mum's blue badge clearly displayed.

I had to go to the third floor to pick her up, as she has mobility issues and would not have been able to make it down to the car without assistance. I appreciate the observation time is quite long, but taking an elderly person with mobility issues down numerous flights of stairs is a time-consuming task as she can only take so many steps before having to stop for a break.

My car was only stopped temporarily for as long as was necessary for me to collect my mother, now that I am aware of the parking restriction I will of course make sure to obtain a permit on future occasions, but I would ask that on this one occasion you please consider exercising your discretion to cancel the penalty charge.

I attach both sides of her blue badge for your records.
