Hello,

I unfortunately received a PCN for parking in a suspended pay and display bay. Due to limited residential parking, this is the nearest place that we can park that suits my disabled dad. We use the RBKC disabled badge and the car was parked there on the Friday before the sign was put up. RBKC rules state that they give notice for a parking suspension on a Pay and Display at least a day before so I think I am out of luck there.

6 bays after the disabled bay was suspended and I was parked on the 6th bay. Usually I see if the parking suspension sign is between the suspended bay they use arrows in the sign (like this <-- bay -->). However this one only points in on direction on the sign (<-- bay) which could be confusing.

Also time of observation is 48 seconds, which seems very short. My car was relocated to a nearby street. I've heard occasions when they call the driver and give them a warning before doing this but I got nothing.

Wanted to check do I have any ground for winning. Any response is greatly appreciated!

The PCN printing is poorly aligned.

So you parked on 10 Jan before the sign went up that same day for a suspension starting on Monday 13 Jan? This is a short time but as you say it's a pay bay. What time did you park? The sign does say it went up on 10 January.

The K&C BB permit saved you from a tow to the pound no doubt so you got a relocation instead.

Well worth challenging.

It was early hours before 8:30am. I didn't see a sign then so it was definitely put up after. I'll write up a response on the basis that it was a short timeframe and that there was no courtesy call which is usually given in these cases.

Do they call you about suspensions?

When did you discover the car was relocated?

Given the PCN was early on Monday you only left the car in the restricted hours of the pay bay for Friday, Saturday morning and early Monday, which isn't that long.

Wait for others and post your challenge here first - I doubt you need to worry about the 14 day window.

This is my first PCN of this type so personally have not had a call but have heard of others that have. Also found a list of paragraph template RBKC use for their responses here and it does mention that the council will try make a courtesy call on the first day, however in my case they didn't even though you could see that the use of the vehicle was for a disabled person in the borough.

I discovered the car at 11:30 on the day of the suspension. They called me at 13:00 to let me know that my car has been relocated.

K&C is one of the few authorities that has a suspension alert email for roads you park in - the only other one I know is Camden. Well worth signing up to. I've never heard of one calling people but maybe there's a service for their BB users.
