PCN parking fine rejected/Pay half price now? ???

I am after a bit of advice please. I got a PCN fine for parking in a loading restricted space in Birmingham on Alum Rock Road.
On the day I did not see any signs or kerb markings. The kerbs on the corners of the road were blocked by cars parked on them. I looked for signs and could not see any because my view was restricted by hanging clothes all over.
I am disabled and there was no disabled spaces to park on the whole road and only 3 spaces on each side street which were taken up and if available would have been to far to walk, and I desperately needed the toilet.
Despite displaying my badge and getting a witness letter from the shop assistant my appeal was rejected saying if I had sent a doctors letter it may have been changed.
On submission I sent my appeal, a picture and a witness letter because I had already displayed my disabled badge. The badge was issued for a medical condition.
From the timing on my clock display and receiving the ticket was a couple of minutes just to use the shops facilities after explaining that I am disabled and desperately need the toilet. My appeal was rejected saying they might have considered if I had sent my doctors letter.
I would like to know if I should pay now at half price or what are my chances at the tribunal and to wait for tribunal?
Any advice, guidance and support welcome.

Paying closes the case - you can't pay half and continue.

Where on Alum Rock Road - it's a long road.

It looks like there are single kerb blips but council pics not clear and no pics of signs.

Asking for a doctor's letter is ridiculous but do you have anything official from GP or hospital that could help as they will cancel with relevant evidence.

Hi.

It was outside 172 Alum Rock Road.
I have an diagnosed condition letter from the hospital. I will try and locate it and send it to you as soon as possible.

No, don't send to me. If you think it supports why you had to stop there send it to Birmingham referencing their letter and the PCN number.

You can message me if you like though.

There is a sign outside no 172 showing no waiting/loading 1pm-7pm and there does appear to be a yellow line and single blips but they will cancel if you give them the evidence they ask for.

Okay. I will send them the evidence despite them saying I have to wait for the letter to arrive and then go to tribunal.
The sign outside was covered with some posters on the day

Sorry yes you can wait for the notice to owner and then reference their rejection and supply evidence.

The NTO is sent to the registered keeper as on the logbook - is that you and are name/address correct.

You can also send evidence now as this should work too - they are saying if we'd had that we may well have cancelled but you weren't to know at this stage.

Following my PCN notice in May when I was informed by Birmingham City Council, if I had submitted my medical information then the fine could have been overlooked. I sent the evidence later and was told to wait until I get the letter. I have received the Notice to Owner letter. Can you please help draft a copy or give me some terms of the law which will be in my favour. On Alum Rock Road Birmingham, no disabled parking. Only parking is on street corner for 2 cars. They are no way near any toilets and there are no public toilets that can be used nearby.

Post the first page of the NTO hiding only name and address.

Your reps should be a formal submission of evidence they said would've been considered in the initial rejection. They can't wriggle out of that.

NTO date is 25 July so plenty of time.

Is the letter you have on headed paper and from a doctor/authority confirming the medical issue.

I would send this. On reflection it could be a short version that just addresses the letter - see if anyone else has comments.

Long version

I am making representations against the PCN by supplying the medical letter you said would warrant further consideration in your letter of rejection of my informal challenge.

Your letter stated: “However, I would advise you that further consideration may have only been given if you had supplied a letter on a headed paper from your doctor confirming your medical symptoms and the circumstances as described in your challenge.”

I trust you will now give such consideration at this stage.

As I said in my initial challenge, I am disabled and there was no disabled spaces to park on the road and few on each side street which were taken up and if available would have been too far to walk, and I desperately needed the toilet in a shop.

On the day I did not see any signs or kerb markings, and I can see from your pictures there was a lot of rubbish strewn by the roadside.

I would never knowingly break the blue badge rules but on this occasion I did not realise I had.

I was only in the shop for a few minutes to use the facilities as per the witness statement I provided in my challenge.

I trust you will now cancel the PCN after reading the enclosed medical letter that addresses my needs as a disabled person, and look forward to your positive reply.

Good afternoon. Hope you are well.

I sent the long version to Birmingham City Council and have had a reply back.

I have attached it for your inspection and further guidance. I have asked my GP if a letter could be done and they have said it will cost £25. To be honest it's £25 that I don't have unless I borrow but want the Council to reimburse because they requested it for further information. I have 18 days to reply back to them.
