PCN Lewisham contravention 53j
« on: »
I received a PCN for failing to comply with restrictions on entering a pedestrian zone  https://imgpile.com/p/pMzcpt4
On my car the time was 14.43, enforcement starts at 14.45. I was just driving in to park the car at the top of the street.

This isn't a private parking issue - it's a penalty charge notice which is different.

You should probably re-post in the correct section.

First thing to do with these types of penalty is a search using Google to see how many other people are being caught out by the road scheme. You can then use this as evidence in a TPT appeal for inadequate signage.

I have received a PCN from Lewisham council for failing to comply with entering a pedestrian zone. I entered on at 14.43 on my clock. Restrictions start at 14.45. Do you think I could appeal the ticket?

Can you post the images the right way up, please.

Two minutes would be within a de minimis consideration, in my opinion. After all, have the council shown you the time on a clock at the sign ? Of course not !  There was an adjudication a few years ago where the council said their CCTV clock was synched with an atomic clock so was accurate. They lost the case, and the adjudicator said there had to be application of common sense, as nobody had clocks in their cars that were so synchronised.

It really is about time this sort of thing was stamped on heavily, but who is going to do the stamping ?

This is a council PCN so I have moved this post to the Civil penalty charge notices (Councils, TFL and so on) forum.

To help the users there provide you with the best advice, please read the following thread carefully and provide as much of the information it requests as you are able to: READ THIS FIRST - **BEFORE POSTING YOUR CASE!**, This section is for council, TFL, Dart/Mersey/Tyne etc. cases
