Re: Appeal Against Penalty Charge Notice HZ92716735
Vehicle Registration: LN25YKG
Date of Alleged Contravention: 17/05/2025
Contravention Code: 52M – Failing to comply with a prohibition on certain types of vehicle (motor vehicles)
Dear Sir/Madam,
I am writing to appeal the above Penalty Charge Notice issued to my vehicle on 17/05/2025 at 23:55 on Imperial Road SEbnd – NW of Fulmead Street.
I am a licensed private hire driver, and at the time of the alleged contravention I was carrying out a passenger drop-off. The passenger's apartment was located on that road, and there was no alternative way to access the address other than by entering the restricted area.
The passenger was very tired and intoxicated, and I felt a duty of care to ensure she reached her apartment safely. That required dropping her as close as possible to her door. She also told me that Uber drivers had dropped her at the same location before, and that there had never been any issues. Based on that, and my understanding that private hire vehicles are allowed to drop off and pick up passengers in restricted access zones within Hammersmith & Fulham, I believed I was acting within the rules.
The only reason I proceeded into the restricted road was because I understood that PHVs are generally permitted to access such zones for legitimate drop-offs, especially when a passenger confirms it has been done before without issue.
I have attached proof of the completed booking, which confirms the time and location of the drop-off.
I was not attempting to bypass a restriction or use the road as a cut-through. I was simply trying to do my job professionally and ensure the safety of a vulnerable passenger. I respectfully ask that you take these circumstances into account and consider cancelling this PCN.
Yours faithfully
