Kensington PCN - Contravention 11u
« on: »
Hi,

I received a PCN for parking without payment of electronic charge. I have been living in the borough for over 2 years and park off street. As you can see from pictures attached some bays are for pay Park and others for resident permit. I have been and had parked in the residents bay (I live on the street) but received the ticket. From pictures it's not clear how the enforcement officer thought I parked on the pay Park bay. The picture shows parking signs which also shows permit holder sign. Are there any grounds to contest? Thanks for the consideration.

So what side of the sign in your photo were you ? Left side is pay only, regardless of permit, right side is permits only.

Right side. I live on the road for last 2 years. I am unsure how to prove it and left side is only 3-4 nays which are pay only and the EO could have took picture with the sign and car but nothing is there and I don't have anything to prove on the right side either.

I tried to look along Cornwall Crescent using GSV, but it's in a real mess when one gets near your location. If you could post photos showing where you parked and with the sign in view it would help a lot. The sign with the arrows should be accompanied by a separation marker. This is a double-dashed line at right-angles to the kerb.

Well you do, because the photo of your car with its background shows precisely where you are on the street. It then becomes a matter of photographing the parking sign in the same context.

Well, Adl-455, sorry to say it, but you look bang-to-rights. The photo of your car shows you by the only place on that terrace in background that has no railings, all the rest have black-painted railing.  So you were to the left of the sign, and therefore in the pay-to-park bays.

So unless the PCN contains fatal errors, the discount looks your best option.

As per the guidance here https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/read-this-first-before-posting-your-case!-this-section-is-for-council-tfl-dartme/ please re-post the PCN with the number plate visible. Or just tell us what the number plate is.
