PCN Contravention 53C
« on: »
Hello all,

I have today received a PCN for contravention "53C Failing to comply with a restriction on vehicles entering a pedestrian and cycle zone".

Is there any basis for this to be appealed?

The satnav didn't mention anything about the timing restriction.

Thanks

Please give us the reg mark and PCN number, and also a GSV link to the location, and the remaining pages of the PCN.

GSV latest shows the signs covered over with grey paper, so we can't see what the restriction times are, but whatever, this shows the hazard of using satnavs in minor residential streets in London.

Satnavs are never fully up-to-date and, indeed, seem to induce automatism in drivers who obey the instructions, but don't look out for restriction signs. So your PCN is what I call a "satnav-assisted PCN". How councils must love people using satnavs !!

In cases like yours I always ask the OP to tell us how they approached the restriction. Head-on to the signs is hard to appeal against, but turning into a restriction really needs some advance warning, but GSV shows none. Are you able to return to the site to take photos ?

In addition to the signage adequacy issue, (the legal requirement), there may be a technical appeal based on council mismanagment of the enforcement process. Such appeals have nothing to do with the contravention, but turn around council statutory duties in the enforcement process.I'm not an expert on these but our Hippocrates is, so wait a bit until he posts.

Hello,

These are the road signs taken yesterday for the location of the contravention.

As the deadline to pay is on Monday 2nd, I want to check if this is something I need to pay or if I can appeal this.

https://ibb.co/vC43dP15 - This one is the location on the PCN
https://ibb.co/gZPbxyzX - This one is from the other side

Thanks

YOu haven't told us yet of your approach to the signs- left or right turn, or head-on.

Hello,

It was a left turn from Higham Hill Road to St. Andrews Road as the contravention signs are on the entrance of the road as per the image https://ibb.co/vC43dP15

So basically the opposite direction of the image and then turning into this road.

Anything else, please let me know.

Please confirm the following journey;-

Higham Hill road, then turn left into St Andrews Road, then right turn into Lowther Road.
