PCN ,code 02, parked in a restricted street , Harborne

Good evening

Received by post yesterday PCN with attached photos to registered keeper .
I parked recently in Harborne, st.John Road for  couple of minutes to grab a drink  as just had dropped wife to A&E in sudden serious med.condition. On way back to car I noticed traffic warden on the bike taking my car details. I informed  her I  had just left wife critically ill in hospital so asked her to not issue any fine as I was going to drive away. She replied there was instant fine and I could accept the fine.
Without further ado I then  got into my car and drove away as had enough for the day.
please check if there is any chance to avoid that pcn

They can send a reg 10 PCN if the CEO really was preparing a PCN and couldn't serve it but here there are a lot of pictures and I'd say the CEO was focusing more on those than PCN preparation.

In most of these cases they don't have time for much if any photography as pics are often taken just before and after serving a windscreen PCN.

Well it seems clear that the council have acted correctly in issuing a Reg.10 after your driveaway. You have only two  possible avenues of approach to representations, (1) mitigation - your wife in A & E, your short time parked etc or (2) put the council to the test that a PCN was in course of being prepared when you drove off.
Frankly, I think this latter is a doubtful approach. However, it's the only approach that will get you to the Traffic Penalty Tribunal, because Option (1) is based on mitigation, which adjudicators cannot rule on.

Thank you for advice .Have A&E proof for that mitigation but if the 2 option is the only way to go forward ; then could the footage from CEO live cam would  be taken into account  for traffic tribunal decision ?

The council will use whatever evidence the CEO can provide incl. his notes for this particular PCN. Frankly, I doubt whether you'd win this one at the Traffic Penalty Tribunal, but you have the right in law to take the council there. All you risk is the full PCN penalty.
