PCN challenge (paid congestion charge instead of ULEZ)

Hi,

My dad travelled to London a month ago to visit my cousin. My cousin paid the ULEZ charge a day in advance of the travel.

A week later my Dad received a PCN of £90. I asked my cousin for the receipt and noticed that she paid the congestion charge of £15 instead of £12.50 and she mixed up the O for 0 for the car reg.

I challenged the PCN by submitting proof (receipt + bank statement) and explained the situation that it was a mistake and she paid the congestion charge rather than ULEZ.

My request was rejected. I’m thinking of re-appealing once we receive the letter of rejection. Does anybody have any advice? Even if we have to pay the fine, will we get the £15 back that we paid for the congestion charge?

Post your letter and the rejection hiding only name and address.

They won't refund the congestion charge fee so need to focus on anything in the ULEZ PCN.

I haven't received the Notice of Rejection yet. On my TfL account it says:
Rejected Representation - Discount Period Reset
TfL has rejected a representation received for this PCN. The discount period has been reset for a specific duration.


I wish they had given a reason as to why my initial representation was rejected as I did explain the situation and attached proof.

It will be in the letter so post when you get it. They can use discretion instead of computer says no.

Your father travelled to London and entered the ULEZ zone. He did not enter the Congestion Charge zone, so we can forget about the CC;

Someone attempted to pay the ULEZ charge on his behalf in advance for 1 day and actually overpaid. However, they did not enter the correct VRM and therefore in effect the ULEZ charge was not paid.

A PCN was issued for failing to pay the ULEZ charge.

Hopefully your father was within the zone until no later than 23.59pm.

Is this what happened?

Is this what happened?

Yes, this is exactly what happened. My dad was in the ULEZ zone till around 7pm.

What is the amount they want now - is the discount still available as they promise, in which case I'd say pay it.

They've not really addressed a plea for discretion given the CC was paid by mistake and just indicate they are not prepared to trade off one for the other, which is to be expected.

See what others say.

The amount is still £90.

If I appeal it, and once I send the letter, will they pause the fine? Also, is it possible to pay the fine and still appeal it?

I'm just worried they will take ages to send out a letter as this letter took 9 days to arrive.

An appeal to the tribunal will be at the full £180 and the adjudicator can't use discretion but can determine if TFL acted fairly to your representation. I don't think there are grounds to find for you.
It's possible TFL may say they would still accept £90 at this stage but that's what you have on the table now.

Did you read the instructions in the READ THIS FIRST -* sticky post at the top of this forum? I guess not as you were explicitly asked not to redact the PCN number and the vehicle registration. So why did you?

Just because TFL issued a ULEZ PCN doesn't mean that the car is not emissions compliant. The ULEZ database of vehicles is not infallible and nor is it real-time. There are errors and omissions however nobody can check anything as you have redacted the required information.

Your car is a Merc E-class diesel, registered 2011 so is very unlikely to be compliant with ULEZ requirements, and indeed, this is confirmed when it is checked on the ULEZ checker.
