I was served PCN today.I arrived at MS car park and was trying several times to register into PabyPhone App to book my free parking. If you resident you are entitle to 1h free. I logged on I have chosen location and my registration number. The next step should be to ‘enter the length of stay’ this one was just not coming up at all! Nothing to choose.  I decided to take screenshots of 3 attempts showing that there was no option to proceed further. I went to the shop was there for about 40 mins. When came out the OFFICER was there taking photos of my car. I was trying to explain what happened, tried to show him my screenshots no luck. Of course I do have a receipt from the store too. The mam was very rude.  Went on my app in front of him to show him that it is not working but he didn’t wanted to listen instead was blaming me for not having a confirmation. Any advice please? I am planning to challenge this as it could be due to malfunction of an app and a proof that I was actually shopping at M&S
I also have a short history of parking at that spot before always registered no issues with an app.

All you can do at this stage is to submit an informal representation giving the reason you could not purchase a ticket and also point out that you regularly park there with no problems using your pay-by-phone app. Attach what you've shown us as well.
Post-up their response when you get it. Best not to be "confrontational".

The contravention is not displaying a ticket not for an electronic session - do they still have ticket dispensing machines?

I received an email from Council today and unfortunately they didn’t cancel my PCN. Yes there is some standing machines to pay and display. Unfortunately I didn’t even think to go and check if I can print free parking ticket ( I know my fault) Looks like I would need to pay? Still showing evidence of shopping at M&S I was hoping to get cancellation.

@Beata the council always rejects everything because they know that most people will just give up straight away. In practice if there is a pay by phone option you can't commit a failure to display contravention, because even if you had completed the session on the app there still wouldn't be anything on your dashboard!

Case in point, Lydia Russo v Plymouth City Council (PL00004-2401, 12 March 2024).

That’s so true thank you. They do have this equipment where they type reg number and are able to see if it’s on the system as parking session completed. The officer showed me that all other cars were registered and only “I had a problem’ Yes mine just didn’t work.

Thank you ! So now I have to wait for the Notice to owner. How long do you think it will take to get it?

Technically they have six months, but it's likely you'll get it before the end of June.

You could keep an eye on the PCN status on the council website, if this indicates that the NTO has been issued then you can submit a formal representation, you don't actually need to physically receive the NTO in order to challenge it and this would avoid the risk of it going missing in the post.

Good morning, just wanted to ask again if there is anyone available to help me with my Representation form?  I am not sure on which grounds I can do it ? I was thinking that I can tick following:
1) The contravention did not accrue
2) There are compelling reasons, why this PCN should be cancelled

I am not sure what to write on the form. I have parked my car, the app was NOT working, tried several times and took screen-shoots. As a resident of this council I am entitle to 1h free parking ( must register parking sessions following the signs ). I completely forgot about pay machines to print free ticket and went to M&S. to shop. This car park is dedicated to MS . Did my shopping and came out to see an enforcement officer taking photo with PCN on my screen. He didn’t listen to me he wasn’t nice. Showed him my phone the app was still not working.

Any tips please ? As I have to send it asap by post.

Contravention did not occur.

You cannot be penalised for not doing something which is OPTIONAL, you can pay electronically or use a machine and display the issued ticket.

The only umbrella requirement would be payment...but you say that as a resident parking for the time you were is FREE anyway!

OMG Thank you as I am so stressed. Is there anything I can write about “OPTIONAL” choice of registration parking session? I mean none lost money as I went shopping. I want to write that I believed that I can use my free hour and didn’t meant to “wrong doing” at all. It also happened for a very first time. It for not seem fair to be charged for something that would be free parking  anyway ?

Is that good enough?
