I wonder if anyone could help/ advise. I received a PCN for entering & stopping in a box junction when prohibited. I was turning right onto the road from a side road (which I thought was a reason you were allowed to be in a box junction, but may have this wrong). There was no traffic coming towards me from my right, and I pulled out to turn right into the queue of traffic. I must have been in the box junction all of 20 seconds while cars to moved forwards, and didn’t hold any traffic up. Anything I can do/ grounds to appeal??

The offence is having to stop due to the presence of stationary vehicles

Thank you. I had read the initial advice but the link to the PCN hadn’t copied. I think it is there now…

An adjudicator will say this is a contravention but probably express sympathy on difficulty of turning right there.

Is my view.

woukd this not be covered by the right turn exemption? the vehicle in front was also turning right but failed to complete its manoeuvre.

From the law (below) it does seem that you are not in contravention but my view is it wasn't designed for this type of layout.

If it were there is nothing stopping someone driving into and blocking the entire lane while the lane going the other way you want to turn right into is in gridlock. And just staying there. 

That's my reading but others may disagree.

(3) The prohibition in sub-paragraph (1) does not, in respect of a box junction within sub-paragraph (6)(a) of the definition of that expression, apply to a person who—

(a)causes a vehicle to enter the box junction for the purpose of turning right; and

(b)stops the vehicle within the box junction for so long as the vehicle is prevented from completing the right turn by an oncoming vehicle or other vehicle which is stationary whilst waiting to complete a right turn.
