PCN - BROKEN DOWN ON DOUBLE YELLOW LINES

Hi to all.

I broken down on double yellow lines rang my local garage for advice and they offered to pick up my vehicle and within 20mins they came and installed a new battery. I have invoice for this.

Original Pcn was challenged with invoice attached which they rejected and offered me a second challenge with the council which also got rejected and this is where I stand now.

Any help or advice greatly appreciated.

OK, so no re-offer of discount means it is now a total no-brainer to take them to the Traffic Penalty Tribunal, as thhe penalty remains the same, and there are no additional costs.

Doesn't happen like this, there's a sequence of events which we need to know.

Being on DYL is, without further elaboration, a contravention. So, did you park there, under full motive power and control, and then find you couldn't get out of contravention because the battery was flat. And when did you discover this, before or after the PCN was issued? If before, where were you when the CEO appeared? If after, then you were in contravention and your subsequent discovery of a flat battery is not germane.

If you limped onto the DYL because you could not drive under full control and pulled over to stop at the earliest opportunity, no legal places being available? If so, where were you when the CEO arrived?

You need to flesh out the sequence.

Having said this, as you're going to tribunal anyway and procedural impropriety is an additional string to your bow anyway.

Thanks for your time reading and replying.

I was being very brief when I said I broken down on double yellows.

My vehicle has intermittent electrical issues for some time now the garage said it will cost £1500+ to observe the whole vehicle electrical wiring. Once diagnosed further labour and parts charge will apply accordingly. I didn’t go with this option as I only broken down twice in the last 4 years due to this issue.

The contravention occurred as my car lost all power during a right turn into the street. Would not restart. I then pushed my vehicle to the nearest safe place being double yellows rather than leaving it in the middle of the road ( next time I’ll leave it obstructing causing hazard at least a Pcn won’t be written). Rang the garage they said they won’t be long and will call me within 30 mins. I went off to the shops and I got a call in 15 mins they then arrived and moved my vehicle which had a Pcn produced in that short time of 20 mins.

I know your are probably being facetious, but leaving the car in the middle of the road next time won't help as the yellow lines apply up to the middle of the carriageway.

You've redacted the location so we cannot examine your account as would an adjudicator. Knowingly driving a vehicle predisposed to breaking down which when it does is in contravention doesn't normally engender a sympathetic response from an adjudicator.

I went off to the shops and I got a call in 15 mins they then arrived and moved my vehicle which had a Pcn produced in that short time of 20 mins. ...would similarly be unlikely get much sympathy.

I think any appeal would need to look at every aspect, particularly procedural.

An issue which causes a breakdown twice in four years doesn't count as predisposed to me.

I remember having an old banger which had an overheating issue which seemed to have fixed itself as it didn't reoccur for many months - until I was giving my mother in law a lift to the airport one morning at 5am! Had to leave it by the side of the road and order an Uber. There were no road markings so in my haste I thought it was ok. When I returned hours later I discovered a PCN as it was a red route clearway!

TFL to their (rare) credit did eventually cancel it due to the breakdown.

Anyway, the location is needed as is the PCN.

Nice to see usernames that I remember from the old website pepipoo. Thanks to all you guys for what you are still doing.

Some good points raised. I don’t think I explained good enough in my challenge and even now that I’m recovering from the worst flu I have ever had 2 weeks ago I notice I’m talking my sentences backwards. Some kind of brain fatigue won’t leave me.

Stamfordman looking back at it now I agree I should have waited near the vehicle. 30 mins seemed a long time to wait around given that day I remember was scorching.

Anderson I know it sounds contradicting what I meant was the electrical wiring fault was diagnosed 4 years ago by RAC due to car battery power being consumed even when the car is parked and not in use. Since then a Few times the radio settings have reset and electric windows sometimes we’re opening fast then slow. Other things included headlight flickering when using ac or demisters given these issues the car only lost full power and broken down twice in all that period.

Do i provide the actual PCN number for someone to log in?

The location where I lost full power of the vehicle was on a right turn into Ruperra Street off Commercial Road in Newport (NP20 Postcode) soon as I entered this street my vehicle stalled and would not start (push start only no key) pushed it to the nearest safe space on the right about 10 meters ahead just before the little park.
