PCN Bristol Clean Air Zone A370 Brunel Way

Hi,

A family member driving my car was unaware of Bristol CAZ/that the car was not exempt and must also have missed the signage. Honest mistake - not from Bristol so was just visiting. Will pay reduced charge of £69 if we have to, but noticed several successful challenges on other forum posts for Bristol CAZ. It looks like the Date of Notice / Date of Service wording has been tidied up. Is the premium phone number option still grounds for a successful challenge? And how to go about this?

The PCN still has the 0870 number on it, indicating Bristol CC still get money from the call charges thus exceeding the penalty demanded.  As far as I know this has succeeded now quite a few times. Of course, with TPT not having an on-line enquirable register of cases, it is difficult to investigate, unlike the register at London Tribunals.  For me, this is a scandal, but there is nothing in law to force them to do it.

I don't think there are any other appeal arguments.

I've done six appeals against the Bristol CAZ charges in the past few weeks, and Bristol didn't bother contesting a single one.

The latest one was Jack R Simmons v Bristol City Council (BS00684-2306, 14 July 2023), which as you might imagine took very little effort indeed.

Thank you - I've challenged as you have advised. What happens next? Presumably, they will reject it initially? Do I then open an appeal with the Traffic Penalty Tribunal?

No, just post the Notice of Rejection on here when you get it. If you'd like me to represent you at the tribunal, do not attempt to register an appeal yourself please.

The speed with which Bristol CC fold when seeing the representations is quite surprising, except that we must bear in mind that only about 5% max of those receiving a PCN for their CAZ bother submitting reps, so it's cheaper for them to just DNC all these adjudications and still see the money roll in.

Hi. I have not received any written or email correspondence back from Bristol following my appeal on 31/07/23. It is now 175 days since the appeal and the online case status just provides a number to call, with no listed amount due or option to pay.

Is it therefore safe to assume that they can no longer pursue this?
