PCN being in bus lane code34
« on: »
I drive a Motability vehicle. My husband aged 80 has Alzheimer’s dementia mixed he gets anxious and will urgently need loo. We left his RSCH eye hospital appointment and on way home on route Ive not used for many years, I was unaware of much changed layout and my husband needed the loo.  I turned off without realising whole Road now turned into a bus lane at next junction.  Once in the road there are no exits until London Road ahead. Would I be able to appeal this penalty charge? :-\

A typical bus gate trap, but the signage is against you I'm afraid. Here is your approach to the traffic lights: -

You will see the large advance sign indicating buses only straight ahead, no left turn, so one must turn right.

Best if you submit reps on mitigation based on what you have told us in your narrative. If you can provide copies of collateral, like medical records, attendance at special clinics etc, it will probably help your case.

I was travelling the other way to the bus shown in the photo you showed. The road used to be the main route to London Road but all roads have changed and routes redirected.  I am 69 and spent my youth nights out in Brighton but roads have changed dramatically around the pavilion.  Once I had realised I had passed the only left turn and had to keep going to the start of London Road.  I’ve tried to do red line on my pics 🤷‍♀️

I’m so sorry I’m no good at these technical things, I’m not even sure how to reply to responses to my initial post. 🤷‍♀️

Well, here I am, (virtually), in Marlborough Place, which is on your marked route on the map you attached, and here is the advance sign and the bus gate sign beyond it: -

it is the same place as my last post of the GSV view.
So ??????

Thank you for your responses.  I see now from your photo I should have seen that I could have turned right at that sign although I was already travelling in bus lane.  I was by then disorientated and panicking for myself and my hubby looking for a quick left turn to exit bus lane. Any right turn in my memory would take me back to the seafront anyway so I felt trapped in bus lane focusing on finding a left turn to exit bus lane asap. It was my bad but I was totally disorientated by the changes. Last time I drove that way we would bear left past the Royal Pavillion and the road took us straight along to London Road, now it seems at the bend you must turn up by the theatres because road here changes into bus lane 😢. I was going by old memories and by time I realised it had become a bus lane I was already in it. It was a genuine error with no intent whatsoever but is my explanation feasible or should I just pay the fine?  Thank you again x

Certainly do NOT pay until you have submitted some representations and received a response. Your circumstances are obviously only mitigation but powerful in view of your husbands health problems. So submit reps to see whether their hearts really are made of stone. They would normally reoffer the discount if you submit reps within the discoount period.

Thank you again.  I will submit my circumstances and see how they respond.  I will update here in due course.  Best wishes x
