Hit with a PCN in the middle of the night. PCN 52M Bus gate Havering South Street/Eastern St RM1

I have received a PCN from Havering Council for 52M.

It was late at night 23:23 and I was driving to obtain an out of hours prescription from a doctor for my son. I did not see any signs. There appear some road works going on. There are no signs shown on the PCN video but appreciate that in itself wont be enough.

This is a very well known and notorious location, and there have been successful appeals on signage inadequacy. The video shows you passing no signs at all.

Thanks. Should i reply on the absence of signs as the sole basis or should I add any additional grounds?

Before you do anything screenshot their grounds page including the caveat re ticking the box and making a false representation.

Dear Havering

The PCN does not state the grounds on which you allege this PCN is payable by its use of "certain vehicles". Furthermore, when entering your website I am faced with no signage whatsoever to indicate what I am supposed to have done wrong.

Finally, there is one wrong ground on the PCN which does not belong to the 2003 legislation.

In light of the above please cancel the PCN.

I had to send the representation in before your response came in, because of the tight deadline. They rejected the representation on 14th May. I send an appeal to the London Tribunal on 14th June which has been accepted and due to he heard on 15th December 2026 at 16:00.

However, in the meantime I have received a charge certificate from Havering Council dated 12th June. What do I need to do to get the charge certificate cancelled?

To all: my case is at 11.15 on Wednesday. Please feel free to observe. Just phone the Tribunal for the Teams link and tell them it is an observation request and you do not need to give details of the case. The Gallery will be full.

Dear Havering

Without any further ado, 007's PCN must be cancelled as, yet again, you have issued a premature charge certificate. To cite Adjudicator Carl Teper and Martin Wood and Michael Burke before him, this unlawful action undermines the authority of the Tribunal. Not only that, your relentless and intransigent and continued pursuit of cases is unreasonable in the Wednesbury sense. I also refer you to decisions made by Adjudicators Cotton and Greenslade in this regard. This has to stop forthwith.

I reserve the right to mention this at my own hearing and urge you to seek urgent advice from your counsel.
