Enfield - Code 01 - 2min observation for drop off

Hey gang, got this pcn today. Was dropping off a relative at their home where there is a yellow line and a no parking restriction between 11am-12am.

Dropped off an elderly friend and took her into the home, was gone a few minutes, but in that time the hawk had been and gone.

Pcn attached below. Surely I'm allowed 1min50sec for drop off. And there's no signage in any of the photos provided of the restriction.

What are my options? Thanks

Please don't redact the PCN number or the vehicle registration. It is only necessary to redact/obscure your name & address where present.

Sounds like a boarding / alighting exemption might apply.

This is all about legal burdens of proof, yours and the authority's.

Theirs:
You were parked on a SYL indicating a part-time waiting restriction. There weren't any traffic signs in the vicinity to indicate when the restriction applied.
If the authority wish to rely upon the exemption from having to place signage in the vicinity, namely that the location was in a Controlled Parking Zone, then they must provide proof. You could probably check for yourself online. If it is then the authority must prove that the mandatory CPZ traffic signs were in situ when you entered the zone, were clear, conveyed the restriction and were to be seen.

GSV shows you were in a CPZ, but were there signs at your entrance?

If you wish to rely on the statutory exemption of assisted alighting then you must prove your entitlement e.g. who was assisted, why, what happened when you had escorted them to their destination and when did you return etc?

You are allowed as long as it takes to assist the person indoors. No more (no cups of tea!).

DRaft and post here for comment a polite challenge, explaining the circumstances and claiming the assisted alighting exemption.

The traffic management purpose of a one hour zone is usually to deter commuter parking and minimise council resourcing, not  to catch out people going about residential business.

How's this:

Dear Sir/Madam,

I am writing to formally challenge the above Penalty Charge Notice issued to my vehicle on 23 July 2025 at Brookdale N11 on the grounds that I was not parking there.

At the time of the alleged contravention (between 11:19 and 11:21), I had stopped briefly in order to assist an elderly passenger (friend) into their home. I was away from the vehicle for only a few minutes, solely to ensure their safe entry due to their limited mobility.

This was not a case of leaving the vehicle unattended for personal convenience or errand. My purpose was purely assisting a vulnerable person, which is widely regarded as a legitimate reason for short stops, even during restricted hours.

The Civil Enforcement Officer observed the vehicle for only two minutes, from 11:19 to 11:21. This very short duration falls under de minimis considerations, especially when no obstruction or hazard was caused. The action was completed as swiftly as possible with the aim of complying with the parking restriction.

I am happy to produce the following Evidence Upon Request:
   •   A signed statement from the elderly resident confirming I was assisting them.
   •   GPS or phone records showing my brief presence at the address.
   •   Any other supporting documentation if required.

There is string case law supporting my defence. I respectfully request that you cancel the PCN on this basis.

Don't say you are happy etc, just attach copies of the documents.

Now, I am an active 80 year old but,I have to say, feeling rather old at the moment, so whilst you say, "elderly" it really needs more meat, so is this person partly or wholly immobile ? The more facts you present, the better able they are to accept rather than send out the usual Fob-Off letter, and if they ignore all your reps and documents, you have powerful evidence of their obduracy to present to an adjudicator.

Post your reps for review here if you want.

PS - The CEO just sees an unattended car parked in contravention, so serves a PCN to the car. He can't possible know the circumstances. It is their back office who receive reps and should, if they are a good council, cancel the PCN. However, I suspect they are under pressure to get the money in from council bosses, so send out tosh. Hopefully they won't do this to you.
