Really need some help :(

Got a notice from what looks like a baliff related to a country court case for a PCN I didn't even know about till yesterday.

Hes put a notice that hes taking my car unless I pay almost £800 straight away!

It apparently relates to a penalty from 24th Feb 25 that has never come to me

I think there are two PCNs here as £795 is too much for one after a clamping.

Get your V5C logbook out and check the address on it and the date it was issued.

Its apparently just the one. Debt collector keeps texting saying they want full payment straight away.

Your right, just checked the address on the V5 was my previous address, doesnt look like it updated in January when I moved out 🤦‍♂️.

No there are two PCNs,

What is the VRM.

Anyway the only way you get your car back is to pay the bailiff and then you can try out of time declarations.

Or let them take and dispose of the car.

Thanks @stamfordman, I didnt even get given details of the other one. They havent taken the car yet but are threatening, is there literally nothing I can do?

By not updating your PCN promptly on moving address, you have dropped yourself in a big hole from which few escape successfully. Sorry to have to say it,  but experience over the years on this and a previous forum is that most people find it very difficult to justify lateness updating their V5C. There is a process for people who don't receive the PCN(s)

The process is to submit an Out-of-Time Statutory Declaration to the Traffic Enforcement Centre (TEC) declaring that you never received the PCN. The only problem with this is that whilst it's free to submit, apart from a small solicitor witness fee, (or free at your local county court). your SD is immediately passed by TEC to the enforcing council who can object to it, and usually do.  Their objection will be that they sent all the statutory enforcement documents to the V5C address obtained from DVLA, and none were returned because of non-delivery. TEC then reject your SD. YOu can then request a review by a county court judge, which costs over £100 for a papers-based review, or over £300 for an interview with the judge. Neither sum is reimbursible.

Sorry not to be more positive, but that is the truth.  My personal opinion is that the increasing use of CCTV to detect traffic contraventions has combined with the abolition of the car tax disc, which did at least have the benefit of people keeping their V5 up-to-date so they got the tax disc in the post.

Trying get my head round the amount, the following amounts usually make up the bailiff bill for a single PCN

- PCN, (assume £130)
- Charge Certificate (adds 50% = £65)
- Order for Recovery (adds £10 the TEC registration fee)
- Bailiff letter of enforcement (£75)
- Bailiff visit (£ 235)

The bailiff fees are statutory amounts.

Thanks v much Incandescent that's difficult to hear. Just seems wrong that I have to try and scramble to find hundreds of pounds or they take my car. Literally sprung on me yesterday 🥲
Ill have a look at TEC once I try to sort out what's happening with the baliff.

They didnt even give me details of the 2nd PCN which I still dont know.

I dont have the breakdown but can ask for it

Looks like there are two PCN numbers on the bailiff notice.

There are two £130 PCNs which with the enforcement fees together total 2x£280 = £560.

Add the single £235 bailiff visit and you've got £795.

Ah, so that's how it turns out.  I thought that as there are two PCNs the bailiffs could charge for two visits; apparently not.

OP, very sorry to say this, but you are basically, as they say, the architect of your own misfortune in not updating your PCN. English civil law can be very harsh as you're finding out. At one time, one could submit an OOT SD and TEC would process it the same day, and halt bailiff action until the council responded, but those days have sadly gone.

The website tells you all about bailiff enforcement, and what fees they can charge and what goods they can seize. YOu can even get an SD prepared for a small fee if it looks to be a runner.
