PCN Liverpool city council

Hi. I received a parking ticket whilst at the Everton match last night in a place I have parked for 5/6 years. It's a big piece of pavement with wasteland behind it. A few weeks ago yellow lines were put there along the kerb but everyone still parked there yesterday as didn't think it would affect us to be honest. Is there anything we can do to contest this or just accept it? I have attached photos. Are the new lines single or double yellow lines?

I had to go back to 2015 on GSV to see what was there before the ugly steel fencing, and then it became obvious what has happened.  The pub was knocked down and nothing has been built since, in fact the whole place looks a complete sh**heap. However the key thing visible are the double-yellow lines all around the land in front of the pub.

Then as time goes on they virtually disappear on GSV views. So people parked there and the council did not enforce because the DYLs had disappeared.

Then along come the council and repaint the DYLs, (as you say in your narrative). This must have been very recent because the last GSV view is July 2024.  A little understood feature of DYLs is that they apply to a whole road including footways and verges up to the property line. I do wonder if the council saw a "nice little earner" here.

However, against all of the above, is your photo of a Park sign. Can you please tell us where this sign is located on the GSV 2024 view, please, as this could be the basis for your representations. SOmoe more photos taken to show the overall situation would also be better, because the ones you've posted are too close-up for us to get a view of the location as it is today.

They are the only photos I have. The free park sign I think is for spaces on the side of the road but not 100% sure as it's a bit confusing. I have attached the GSV view.

Your last GSV view is very useful. It shows a series of parking bays on Cherry Lane, some for residents only and some for anybody. The sign in your previous post photo is for a bay, and it is totally unrestricted, no times or anything. The bays look recently painted in the GSV September 2022 view. But the almost not there  DYLs remain unmaintained. Now, from what you say, they have been repainted and are now being enforced. So a residents parking scheme has been introduced but it has nothing whatever to do with your PCN other than it seems somebody may have complained about all the parking on the old pub sight, so the DYLS have been repainted and enforcement started, but who knows  ?

So what you now need to do is submit representations on the lines of parking there for football matches for well over 5 years, so astonished to receive a PCN. This is essentially using the "Legitimate expectation" argument, and if you want to take a punt, you could present it to the adjudicators at the Traffic Penalty Tribunal (phone or video hearing). Liverpool council like most councils are very greedy for people's money so it is unlikely they will accept an informal challenge, or formal reps against a Notice to Owner, the nxt stage of the process.

Appeals are what are heard at the adjudicators; representations are what is sent to the council

For a PCN served at the roadside it's a three-stage process.

1. Submit an informal challenge, (representation),  to the PCN

2. If rejected, either pay-up or wait for the Notice to Owner sent to the keeper on the V5C.
  Submit formal representations

3. If rejected, either pay-up or register an appeal at the Traffic Penalty Tribunal

We always recommend people to submit something even if their case seems hopeless, because councils ****-up their replies quite a lot, and this gives grounds for PCN cancellation. Council parking enforcement departments are really quite awful and badly managed.

As far as I can make out from your photos and looking at GSV, any car on that flat area of tarmac where the old pu used to be would be liable to getting a PCN due to the double-yellow lines. Cars in the marked bays with the "Park" sign would be OK.

As for reps, yes, send reps on the basis of legitimate expectation of parking for football matches over 5-6 years as per your original narrative.

Post your draft here for review, then all other documents you receive. Only redact name and address.  I can't help thinking somebody local has complained, so they've gone out and ticketed everybody. The police used to do the same when they had responsibility for parking.

I received a PCN on Saturday 26th October whilst parked off Utting Avenue. I have been parking on the pavement there for 6 years and was astonished to receive a parking ticket after coming back from the Everton match. There has only recently been newly painted yellow lines as previously they were not visible. I along with many other fans were shocked to receive PCN'S as we have never had any trouble in the past parking there.


Is there anything else I can add to this mate?

Put in a bit like - "in view of the very lengthy period of no parking enforcement, it is totally unfair of the council to enforce without giving some warning beforehand."
