Good morning,
I received a PCN yesterday for parking in a restricted street during prescribed hours at Powis St, SE18. I was parked on double yellow lines with my blue badge displayed correctly. The signage states Disabled Bagde holders only Mon-Fri 10am - 4:30pm. I received the PCN at 9:18am. My understanding was that in such zones blue badge holders were exempt from these restrictions and upon searching online I’m finding the same thing. I found a document on the Royal Borough of Greenwich website which states all the streets that meet the traffic sensitive criteria and Powis Street is shown as morning restrictions time 7:30am - 9:30am and afternoon 4pm - 6:30pm. The restriction times on this document are slightly different to the road signage.

Can someone please advise if I’m in the wrong at understanding the signage and I should just pay the PCN or if I have a case to appeal it?

The sign in the disabled bay is not relevant since you weren't park in the bay.

Do you know if there are any loading restrictions in force?

Was the clock displayed?

A GSV link to the exact location would be helpful. Is it around here, on the DYLs abutting the disabled bays?

Please post up an unredacted copy of the PCN. That would be even more helpful.

I didn’t see any loading restrictions. I park there almost every day around the same time and have never got a fine.

The clock was displayed and was showing 10:00. I’m aware that the time was wrong by 40 minutes but that’s just me accidentally not displaying the correct time. Unless that’s why they’ve given me a ticket because of the clock?!

There was no spaces free in the disabled bay so had to park on double yellows.

The kerb blips have almost completely disappeared in the GSV June 2021 view, and it is these that alert a BB holder that he cannot park on the double yellow lines. OK the sign is near, but not seeing any kerb blips why would the OP look around for a sign ?

So the contravention is incorrect. It should be 02o, "Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force (blue badge holder)."

It seems the CEO ignored or wasn't aware of the loading prohibition and I can only assume issued the PCN because the clock was set too far in the future.

You should certainly make an informal challenge. Get it delivered before Sunday the 25th May and Greenwich should reoffer the discount if they reject. So you have nothing to lose and £80 to gain.

IMO, 'No loading' is a red herring.

Yes, the sign is still in situ it would appear, but no kerb blips therefore no loading restriction as confirmed by the contravention grounds. A redundant sign is not a defence in this case because it doesn't bear upon the issue which is that the clock was not set correctly - out by at least 2 quarter-hours if not more. Failure to display correctly means that the motorist cannot claim the exemption.

OP, just submit a 'terribly sorry made a mistake in setting the clock' representation. But add something along the lines of..

For future reference, when you received the PCN you didn't immediately notice that it was the clock that was at issue (you had inadvertently set it at 10am) and therefore you looked around for other indicators. You then noticed the 'No loading at any time' sign to the rear of your car - it can just be seen in the CEO's photos. You park in this area regularly and wouldn't want to fall foul of a loading restriction, which you understand prevents waiting by BB holders, therefore for clarity would the authority please confirm if there is a loading restriction in this area and its extent.

Are you the registered keeper with current DVLA details?

Was it set at 10am because you thought you'd use the disabled bay?

Firstly I just want to say thank you for all of your advice, it means a lot.

Usually I will be parked at the location for 10am as I tend to take my grandson to school first but yesterday I didn’t have to and automatically out of habit I must have thought it was 10am so unfortunately I didn’t think twice.
