Parked in a permit zone without permit - contra code 16
« on: »
Hi all,

A visitor received a PCN in the area where permit parking is required.

The visitor arrived around 7:00 and the permit was applied on 7:15. Therefore the time of contravention was 7:18.

On this basis, the fact that before the time of the contravention a visitor permit had been applied correctly, I felt that would be ok to cancel. however, the appeal for the PCN was rejected by the crooks. FYI - I had actually applied for 2 visitor permits as initially entered the wrong plate number but then by 7.15 made a second permit by entering the correct plate number

Now the visitor being the registered keeper will have to wait for the NTK before the representation to the council can be made to appeal the rejection. Would be grateful if anyone possibly help me on this?

Few clarifications:

The permit type for this is virtual permits - nothing needs to be displayed (see screenshot of the online permit obtained - valid from 19.15 to 22.15). This was for the VRM on the PCN, as can be clearly seen on the right side towards bottom of screenshot.

My understanding is that the required virtual permit was valid (at 19:15) BEFORE the time of the contravention - stated as 19:18 on the PCN

My mention of the incorrect permit was as a side note so that if there is any case in saying that, look I had started applying for the permit before but I had accidentally input a wrong VRM and then purchased another which was in effect by 19.15 etc

Re their reply - I provided the screenshot of the virtual permit, that I have attached to this post, when appealing the PCN. It would not be possible to provide anything else, whether it was me or any other resident in the same boat.

However, I don't know how they can say the permit didn't exist - as the screenshot, which is obtained from their own council permits website, clearly proves otherwise

Council photos:

Looks like the standard fob-off rejection where they don't even bother looking at the evidence before saying you have to pay. Just wait for the notice to owner and then make the same representation again, if they refuse I think you have a chance of getting a costs order against the council at the tribunal stage.

It comes as a shock to many first-time users, but you must remember that where councils say they have very carefully considered everything you've said, this is often a lie. It's just a templated rejection letter they send to everyone in the hope that you'll just cough up the money.
